This might be a really dumb question but I'm just making sure.

The title says it all, would there be a way to make a NAND that can play legitimate games online, even after getting banned?

Bans are handled by cert for better understanding you could that its a unique hwid. Only without hardware. Means the old clean NAND cert is the same and if you ban for example console 1. You can do everything but this console will be banned forever. It's just not console 1, it's console with cert and then your cert. Bin. Sad for you

Would it be possible to spoof the HWID in the EMUNAND?

Nope Nintendo just has better online security you can get banned just by using someone else's save file if its an online game that is. Even the save files generate a unique ID.
I had to buy another Switch just to regain my Smash bros online privileges on a different account as well. Going online in Emunand is a big no anyway since you are still in CFW mode

Yes it is Incognito does it. Side effect: when your anti ban is enabled you can't get online. Means your anti ban bans you temporarily
That's not what Incognito does, there'ss nothing being spoofed, they just delete your info:
Wipes personal information from your Nintendo Switch by removing it from prodinfo.

Would it be possible to spoof the HWID in the EMUNAND?
Maybe eventually but not yet.

To answer OP in a way that isn't just "no":
As far as we understand it, Nintendo can ban your account, in which case you jusst make a new one or ban your console entirely. Because a console ban is tied to your specific console nothing short of a motherboard swap will let you go online again on that particular device, it doesn't matter if you use emunand or not. With that being aid, it's not completely imposssible that someone will find a way to change a console's specific identifiable traits so that whenever you connect to Nintendo's CDN it'll see it as a completely different console.

@Osga21 Sumandora is known for providing the incorrect info.

No, all consoles have unique id (serial number). And you can't just spoof that... So BAN IS PERMAMENT

Also, the idea of "spoofing" the cert in emunand is pointless because you can´t just generate a new one it has to be generated by Nintendo themself. It would be naive to believe that N doesn´t has a masterlist of every produced switch serialnumber and cert, so the only way spoofing can work is if you use an already existing, but not banned, cert from another switch which then can´t go online anymore cause there can´t be 2 certs online at the same time. This would be the same the same as buying a new, second switch for online gaming and use the banned one for backups and homebrew.

Below is my spitballing and rambling, I don't know if this is wrong, but I was assuming that the serial numbers are in a specific format and incremental. As such you could just keep trying until one works. You could potentially cause valid units to become banned, but at some point Ninty would have to change something as inaccurate bans could have people up in arms.
