Experience: I made one CIA application for the 3DS that allows me to explore my files on my SD Card directly on my 3DS but CTRXplorer came out and I deleted it because I was embarrased by how inexperienced I was.
Projects: I'm trying to get SaltySD to work on my SSB bc an exception error keeps appearing and it seems to tick a lot of people off. Also, I have a project called Maximum Momentum, which edits time, speed and space settings in real-time on 3DS. For example, you could input that you want to set coordinates for the moon and it would up your steps, play cool music, and have a snazzy theme and animation of you entering Maximum Momentum on course for the moon. It will also say that you are at the moon on your AC:NL game or other games that display your location. Lots of bugs, and creation percentage is at the opposite of maximum momentum.
Interests: I want to emulate DS games on 3DS, but some of the ones I want to play desperately need AP Patches, and I need someone to do that for me.

There are only four main ways to get banned:
  1. Play a game online before its release date (this famously happened with Pokemon)
  2. Actively cheat online (save game modifications are less likely to get you banned, depending on the game and the modification)
  3. Users of CIA-installed illegitimate titles (FBI, etc.) with specific system sharing settings turned on (this was an isolated incident in May 2017 and hasn't happened since)
  4. Playing online with an invalid header (doesn't apply to CIA-installed games)

Bans are pretty much not a thing on the 3DS anymore. You can get banned by cheating in Pokemon but that's just a game specific ban.

I always did everything you're not supposed to do, save for actually playing leaked games online. But I had the wifi enabled when I played the leaked Sun/Moon and nothing bad happened. I turned wifi off once the bans started happening. I also have a homebrew set as my favorite title. I ran homebrew CIAs while online many times. And I have both data sending options turned on (not that it matters, your last played/currently playing title are still sent to Nintendo regardless and that's an easy way for them to tell if you're running homebrew CIAs or VC injects and if they cross reference against your eShop purchases, they could even tell if you're playing pirated games)
I've been doing all of that since the early days of 3DS CFW up until now. Maybe I just got lucky, but I'm not banned yet.

Said sharing settings don't matter at all for any CFW/piracy-identifying data that is sent to Nintendo. That has been proven by logging the communication.

Considering the survey data, I'm unconvinced that the sharing settings are irrelevant.
The people that made sure to disable those settings were likely more careful in other ways as well, such as not running CIA homebrew while online, one of the things we know they are able to check for. Without making sure that all the other parameters were the same, it doesn't prove anything.

I didn't say it proves anything. I just said I was unconvinced the settings were irrelevant. Given the extreme difference between having the settings on vs. off, I think it's more likely than not the settings played a role.

I just think it's impossible to tell from the poll alone without knowing more details. But I'm not entirely convinced myself.

I had forgotten about the poll TBH. I still stand by what i said, at least from the data logged, there is nothing obviously CFW/piracy related about the data sent except for potentially the last playing/currently playing title. Unless Nintendo know something we don't.
