Looks like they are going to keep it down another 2 weeks.

It appears that github is an easy target for malicious DMCA requests.

It appears that github is an easy target for malicious DMCA requests.

Nice @iriez openly stating China is not civilised. There's a few thousand years of history and a few billion people who beg to differ.

As for China not recognising USA copyright or intellectual property laws because it suits THEM better, it's not like that country is the only one to pick and choose which international agreements it adheres to is it? Cough.. Paris agreement for climate change. Cough. USA.

Seeing the laws and general lack of freedoms enjoyed by China's population... can't say they are a shining beacon for the world to follow. Unless you mean Republic of China (Taiwan for the others playing along at home) of course; they are OK.

As for IP laws there is a difference between doing it as an international sanction ( https://www.ip-watch.org/2013/01/28...gainst-us-by-suspending-ip-rights-protection/ ), maybe not letting the US ride roughshod over your laws (see the continued resistance to software patents in most of the rest of the world despite how much the US would sorely love others to join them in such abominations) and the utterly flagrant disregard and possibly contempt that China holds for the concept in general.

also thinking about it, as it's been a few years since I bothered with them, I wonder if the PS3 CFW still have ''illegal numbers'' stored in them, as they are openly linked and distributed on GBAtemp.

Isn't there a pretty strong case that Switch is a tablet per the DMCA exemption?

I mean the Nvidia tech being defeated here is inside the Shield line that is literally marketed as tablets. And this is a portable touchscreen device with built-in battery, you can even deatch the controllers. The OS and arbitrary marketing is the only real distinguishing factor here.

For their current boot, TX/SX has the tsec key in plaintext in their boot operation. It is not extracted from an end-users' system in any fashion, it is simply there and now distributed publicly.

Welp, my opinion would be that Atmosphere guys are simply on the red line (in the limbo if you want), while SX is clearly selling, for a profit, a device (or code if you like) which allows piracy.
But as long as there's someone willing to pay, there's gonna be sellers.
Gbatemp should maintain a simple rule of: anything that contains copyrighted code must be out of the forums, or else, they will be the same as that dark site anyone knows about.

We can discuss the hypocrisy of America all day long and I will agree with you. But that doesn't mean that China does not have specific laws that are unjust. it also doesn't mean that all of America's laws are unjust. These are illogical arguments, aka strawmans.

Very poor argument from your part, as well as assumptions. I said nothing about Chinese people or Chinese culture.

What does selling enabling code for profit have to do with things? The typical test is "substantial non infringing uses" (homebrew, backups, backups of saves, possibly ROM hacks, abilities for disabled people to be allowed to play... things that would fall under that). Even if "allows piracy" was the test what does Atmosphere do that means it is only sneaky highly technical users operating beyond anything Atmosphere intended, or them having literally no other reasonable way to run stuff, that can play pirated works on their code? As far as I am aware they support common formats that are readily used to install the commercial game offerings, just not the really juicy XCI one at present.

Also copyrighted code is allowed. You just need to be authorised to distribute it -- if I write a story to my game then I own the copyright to my story and I am still allowed to distribute the game, not to mention most open source code is still copyrighted but the levels of authorisation granted to use it/redistribute it make it such.
Similarly the keys that this little discussion is possibly revolving around are not a copyrighted, or copyrightable work. They might be afforded other protections but copyright is a specific one. If this is about them borrowing pieces of code and not releasing the source to conform with licenses then so be it.
