Atmosphere definitely violates DMCA by breaking encryption. Nintendo could go after them through that if they wanted. Keys violating copyright is questionable at best. Doesn't seem like anyone's tried to take a key release case to court for copyright. DMCA seems to be what everyone decides a key release violates.
