i still blame the users for not following step one and making a nand backup, its not a hard concept to grasp unless you're butthurt about getting screwed over~

Not sure if that would work but I think that was tested as an SX cracking method once. It worked, however it was really unstable. I hope that somehow we can make those Switches lost usable somehow, whether or not it be via cfw.
If a nand backup was mandatory it would be done the moment you hack your switch and not by the user but by code, the fact that it isnt is proof in itself that it is optional. Thus rendering your senseless logic yet again, useless.
Tell me, how have I and so many other users been on the homebrew scene for over a year now with no nand backup? Its because switches dont just magically break on their own, if you follow instructions properly you dont have the ability to brick your switch even without a nand backup. Now someone creating destructive software that purposely destroys is a different thing than someone not following instructions.
Like my guy, I am a developer myself and I can tell you I have the ability to drop applications that can shit on your pc, phone, and with a bit of practice even your home security system or car. Does this mean I am justified in doing so the moment you leave yourself vulnerable because of your lack of AWARENESS that such a flaw exists? No. There is no defense for it.
Why do you think nintendo cant remotely brick a console? Its because even if you are breaking the law, they cannot break it in return and take matters into their own hands. There is a system and protocol for everything. For someone to destroy your system regardless of what reasoning there is behind it, is still legally defined as "destruction of property" now anything over 200$ in value that gets destroyed is a "felonious destruction of property".
Lol it would hold up in court easily. When you go to court they dont care what you were doing that got you into the situation. They only care about the charges they are there to discuss. They wont look at the case and say: "well, you were breaking the law by selling drugs so the fact that this person shot you doesnt matter and we will let them go." They will still charge that person and if you dont have a case pending of your own for selling those said drugs they will not prosecute you. They would have to prove beyond a doubt that you were indeed selling those drugs to begin with and catch you with them. Telling them is one thing, but they need evidence and the only evidence that would be present is your shot up leg. Thus giving them a case.
I know all of this but would I go outta my way to be a snitch? No.
Would I go outta my way to ruin another persons day? No.
Would I design code that would cost people money at no benefit of my own? No.

I'm lucky to live in a somewhat better country. However, in some countries, kid or not, you get hauled up. Either by the police, or the underground. People don't care. Get them angered enough, if the law doesn't work, they'll resort to the underworld's laws.

In this case the driver is fault and might get a fine for turning right, but the person digging the hole is guilty of a much more serious matter as he deliberately caused damage on other peoples property, even tho there shouldnt be a car driving that road.

What if the next malicious payload learns from that, and trashes/encrypts the "save" and "saveMeta" folders in the USER partition, as well as PRODINFO?
If only someone tried to make money from such a prank, maybe this could've been put to the test.
TBH overwriting PRODINFO with "BOOBS" is amateur hour.
This could've easily been made into ransomware.
e.g. Encrypt PRODINFO and the "save" and "saveMeta" folders with a randomly generated AES key, then encrypt that AES key with a public RSA key included in the malicious payload, and store the RSA-encrypted-AES-key in USER.
Then release a payload that dumps that RSA-encrypted-AES-key in USER to the screen, along with a bitcoin address, and an onion.to link to a darkweb site where you can verify payments and unlock keys that have been paid for.
If someone does this, even for just $50-100 a pop, THEN we can easily see if the "can't sue for it because you were also doing something illegal" thing will hold up.

In this sense it would almost be accurate heres why:
In this example the no right turn sign is the nand backup.
The issue is that the nand backup is NOT mandatory, it is optional thus not matching up with the no right turn sign(completely mandatory)
Also, I would like to point out that if you go into the choidojourNX thread there are users who cannot recover who also DID follow that no right turn sign and turned left instead(made a nand backup) if there are giant holes on both sides of the street created to harm cars and potentially the drivers within them, it does not matter which direction you turned because you can fall into the hole either way.
Right turn or left turn, following the warnings and precautions or not, there are still harmful results to anyone who chose to drive on that road.
Moral of the story: You cant blame a person for getting into their car and driving, but you can blame an asshole who throws rocks through their windows and kills the driver or places a potentially dangerous obstacle in someones path.
Let me ask this one last question:
If someones shoes are untied and you see them standing on one of the shoestrings, are you justified to push the person and force them to trip up and say "well you should have had your shoes tied"?
My answer is:
No because it is not the persons fault they fell. They didnt fall on their own accord, you thrusted them and forced them to trip over the shoestring that was untied.

A joke would be to tie their shoestrings together and then tell them about it before they fell, thus teaching them to the lesson to pay more attention to making sure they tied their shoes.
Long story short, they could have made code that just crashes the game or exits it and displays an error that says: "Hey we wanted to make sure you knew to make a nand backup if you already didnt have one. We hope this spread awareness."
Not make code that will punish anyone who didnt follow a specific instruction or happen to keep backup files stored somewhere on their pc or harddrives. Not everyone has access to that, you all are forgetting that some people hack their consoles with their phones and never use a pc to do so. Some also transfer files by plugging it into their sd card slot on their phone and copy pasting. Not everyone who uses phones to hack their console is gonna wanna dedicate 30gb of data to a backup of something they may never need when most phones only come with 32gb internal storage or 64gb.
