I keep emailing the user agreement email for (NA) region daily. Stating isn’t it theft to lock me out of my purchases? I keep asking for reimbursement and or a check. Of course no response. So to compensate, I help every poor soul online via comments or tweets with homebrew or helping with testing for research methods or files. XD They give me the cold shoulder, I rub it back a little. The email starts with [email protected] Pretty fun to do actually, I’m simply getting my money’s worth back for locking me out my purchases. :D Tomorrow marks one month. *cheers*

Got banned today from Online Service, Patching dont work, but System-Update work.

100% Sure it was ReiNX, never had any issue with SX OS, after I switched to ReiNX (because I wanted to use NSP better)
Instant got banned.

So yeah, not saying SX is save, but I guess more save then ReiNX / NSP usage. Time to buy a new Pokemon Bundle.
Install nsp on no emunand, is almost a direct ban that is why you get banned. Xci a little safe than nsp

When you use eshop you agree to a ToS which allows them to essentially revoke your purchases if you modify your system. Don't like that, buy physical or don't modify your switch. Legally they don't have to give you anything, and since it's not the account being banned you still have access to your games if you unlink your account via the website and buy a new switch.

So I've been in contact with Nintendo to ask a couple of questions without giving out anything about my console.

I mentioned that I booted into CFW just because it wouldn't boot anymore even though it was a virgin console with no third-party accessories or CFW whatsoever and that I only used the CFW to push my savegames to Nintendo online and then proceed to reformat it. He said that if I give him the serial number he could check if it was banned but he could not check if it was flagged. I did not give him any serial numbers but proceeded to ask if I could still send it in for repairs in the future and if I void my warranty by booting into the CFW.

He replied that he thinks that my console won't be banned from what I did but that I can't send it in for repairs if it gets banned... I thought companies are not allowed to refuse repairs even if you ran custom software on it? I asked him about this again and waiting for a reply now.

your first mistake was ever mentioning cfw since thats going to make things dicey to get repairs at all it voids their TOS right off the bat

Which is why I didn't mention anything about my console and sent the questions from my work mail :D
Oh I read it wrong, but heres my question. Why would he check the serial to see if its banned if you can't even boot your switch? that doesn't even justify a banned console. I'm kinda lost on that part

I agree, I think he wanted the serial number to make note of it in case I decide to send the console in for repair. It's the only repair shop we have here in Sweden...
Decided not to give him my serial number haha

Excuse me, what? I they don't want to admit, how you know it?
I've filtered the ban sheet and i couldn't find any new reports of bans caused only by homebrew use.


Also, thanks for keeping track of all reports for all this time, it's being really helpful.
They are annotated with (Homebrew) next to their usernames. Maybe I should put a legend for this type of stuff :P

Can i have an update about bans ? :)
I'm thinking about hacking my Nintendo Switch and now i see a lot of stuff regarding Emunand and how it can prevent from being banned by Nintendo so i just want to know if it's the right time to take the leap and try hacking my Switch using Emunand while offline and OFW when i want to try the games that i bought.

Would you recommand to do it or do you think that i should wait ?

So I managed to return my other console and get a completely new one. First thing I've done with my new one is start it straight with hekate to make a full NAND backup. I've also kept a full copy of the nand and keys from the switch I returned, anything fun I can do with those copies :D?

Also, I've done my research now and from my understanding making 2-3 full backups of BOOT0/1 and NAND is enough and then never go online when I start to hack it? If I do wish to go online I'd restore the backups of course

EDIT: I just checked how many fuses have been burnt in hekate. It's 5 which means I'm on firmware 4.0.0-4.1.0. AWESOME STUFF :D So happy now haha

The "EmuNAND" that is currently available isn't the EmuNAND solution that the community is used to; rather than being emulated from the SD card, it is emulated from within the NAND. Because of this, I and a lot of other people wouldn't trust using it since anything in the NAND is fair game to be detectable by Nintendo and thus lead to a ban. If the EmuNAND was on the SD card, it would be a lot safer. That being said, no one has been really banned for using this EmuNAND implementation...yet so it is up to you if you wish to take that risk or not. Lastly, ReSwitched is currently working on the true EmuNAND solution for their CFW, Atmosphere, but there is no ETA on that currently.

All right, mmmmmh very tempting to try out that actual Emunand and get rid of all my cartridges when i'm going away for vacations...mmmh i'll think i'll buy Xexcuter solution and wait till a firmware update is safe enough to go online with OFW while using a CFW

Additional Comments

  • I've been using CFW since OFW 4.1.0. I'm still not banned.
  • AutoRCM is usually enabled. I enter OFW through the SXOS option.
  • I allow the eFUSEs to burn when updating to avoid an eFUSE count mismatch.
  • I used emunand on OFW 6.0.0, but then deleted it before updating to 6.0.1. I didn't restore from a backup afterwards.
  • I've used ReiNX and RajNX in the past, but always restored from backup before going online. I don't trust them to keep me safe from a ban. Open source software is not the best choice for security ;)
