Nintendo couldn't care less about secondhand sales since they see no profit margin from these units. If anything, they'll just tell you to buy New consoles from them next time instead of trusting random resellers.

Nintendo probably unbanned if they have to sell as refurbished on their website.

Been using SX OS since 13/7/2018. Update xci games in non-trimmed form through OFW, after that switch to trimmed version to save some space. Always delete internet settings and enable airplane mode before boot into SX OS. Using second account to play all XCI games.

I used pegaswitch to set the rtc to play flog about 10-11 months ago (FW 3.0.0). My switch is now on firmware 5.1.0 and I never used any other homebrew/cfw, if I update to 6.0.0 how likely is that I will get banned?

Alright so, my new Switch for Hombrew and borrowed games... is on the way arriving monday. I see that homebrew only will get you banned now... is that accurate? What about updates online for XCI games on OFW?

Updating XCI games in OFW have already banned plenty of people; in fact, these people were the first ones after the LayeredFS banwave.

Great. I'm gonna be screwed again. Lets see how far i go without getting banned... Will try ticketless NSP and updating over the internet certless xci games... anything else i should try? I mean the whole point of that Switch is to get it banned and see what is causing this.

I don't think anyone was banned for updating .XCI games in OFW without AutoRCM so you could try that. Despite the fact that people have been banned for this, majority of users are not banned for doing this so it seems pretty safe.

What do you mean without AutoRCM? I dont use AutoRCM... so update XCI games in OFW without ARCM has not been proved right? Ok lets stick to that one for now. Testing starts Monday!

Hmmm, interesting. I have been updating trimmed XCI games on OFW for a long time now (only that, no AutoRCM or any other hacking related stuff) and no ban, so i think theres something more than just updating. Any ban caused just for using AutoRCM?

Nope so its definitely weird. Then again, no one is silly enough to mod their Switch only using AutoRCM practically. However if anyone wants to test if Nintendo can detect AutoRCM alone, I am more than interested in hearing the results.

I think, updating XCI from CFW is safe.
I was doing this for months and I think they can't detect the XCI cert is the game isn't mounted.

But they can ban you if you play with an XCI with airplane mode OFF.

Exclusively used my switch to play homebrew emulated games back on 5.10 (I believe it was), just updated to 6.0.0 and am now 2124-4007 (The use of online services on this console is currently restricted by Nintendo).

How did you update the xci without installing NSP and without going to OFW
did you just put it out of stealth mode and then choose to update when starting the game ?

Hi, I resotored my NAND to check if I am banned. Still not banned (yet). But I didn't update to the latest fw. I wanted to stay 5.1.0 until there is a game I wanted to play that requires 6.0. Btw, I forgot to backup the NAND I am using to play NSP before restoring the clean NAND. How do I restore my games? The games are still on the SDCard, but not appearing on my home menu when I inserted my sdcard. Is there any other way for my games to reappear without reinstalling them? Thanks.

How did you update the xci without installing NSP and without going to OFW
did you just put it out of stealth mode and then choose to update when starting the game ?

1. Don't understand the first part. Thought .XCI and .NSP are separate installs, I've never installed an .NSP/.CIA on my system. I've learned with the X360/3DS scene to never install .NSPs or any other files onto a system without emuNAND or some sort of safeguard, it's just way too risky at the moment. I update XCIs with auto update (Super risky right?). It hasn't flagged my system at all for the past 4-5 months.
2. No stealth mode. I've ran everything without it. Even when SX OS forced itself into stealth mode I turned it off as soon as I could. (Super risky again right?)

A little writeup on my experience:
I treat SX OS like a flashcart, like R4 and Sky3DS. I don't try to install anything onto the system (sysNAND) at all, I believe that to be a huge red flag to big ol Nintendy. When everyone is on the train for LayeredFS and .NSP, I'd rather watch everyone go through their paces and see which people get banned and not. Generally modifying anything on sysNAND is hugely dangerous since you're changing system files not emulated. We need true emuNAND support before we do any changing of the original software. If you're banned already then do what you want with the switch. People also like to run .XCI files without headers or legit certs, I learned my lesson by reading up on the Sky3DS back when there were Pokemon banwaves. Be smart and take things with a grain of salt when new tech/software comes out.
