You can legally make a backup, but it's legal gray area for bypassing copyright protections to play those backups (leaning more greatly into the illegal side of the gray area).
And even then, just because it's legal doesn't mean it's not against tos. Mostly because they want you to buy digital if you want the luxury of using a digital copy

You shouldn't tell other people to do this, people do get banned. Little kids will take it hard.
I started reading this thread bans again back in page 70 and i noticed something that is worth highlighting:
- Majority of the banned consoles had NSPs installed. What seems to have triggered the bans was these 2 rows: Updating them online/Opening the Eshop (tells Nintendo which software you have installed, and they ban you accordingly).
- 99% of the unbanned consoles either had no NSPs installed or had NSPs installed but the 2 online update/eshop rows where false.

I think this is just a limitation of what the spreadsheet can display since I don't ask people if they use .XCI files offline or online. A safe assumption to make is that anyone using SX OS is generally using .XCI files since that is its unique feature since day one. Now we don't know if people are getting banned after installing .NSP files but I was waiting until other CFWs supported .XCI loading to ask if people used them. Also, trimmed .XCIs imply people are using .XCI games which a lot of people have said yes, with and without SX OS.
Just for installing them probably not. What i believe is causing the NSP related bans is checking for game updates/opening the eshop (console reports installed software), this must the starting all kinds of red alerts on Nintendo's server logs.
It could also be that maybe they are not outright banning everybody, maybe there is a threshold of infractions before the ban... idk. Like, lets take into consideration how people who cheated online were banned from online multiplayer only, for cheating they have probably hacked their devices first, but even then Nintendo still doesn't outright ban the console from the cdn according to the reports.

Did you have your cart inside the switch when you played your backups? I was under the impression the certs were on the carts and that's why xcis couldn't go online. Did you inject your own certs?

On the N site I have not allowed to share any information in my account settings. I am able to access eShop and play cart games in horizon still. I never access eShop or play cart games through CFW.
I await the almighty ban hammer and have a second switch.

Bear in mind that Airplane Mode can get disabled if entering sleep mode or switching between docked and handheld modes. Also while I see step 2 is to backup the NAND that Nintendo last saw, I'm reiterating that this will need to be done before you go back offline again with hacking. I would also consider unlinking a Nintendo Account with purchases on it because while the account itself may not ever be banned, unlinking it after the console is banned can only be done after calling Nintendo. If you do unlink it, I would suggest linking a dupe/fake account so you have eShop and online play access. Lastly, I would not restore saves made with games that you don't own. Regardless, your plan seems pretty well thought out.
