Can I get banned if I install NSPs offline and restore a clean NAND before I go online?

I have been installing NSP offline since day 1 and I'm still not banned and tbh I would be shocked if I ever get banned

All you need to do is make sure you don't run backups online, cfw online, nsp online.

I only play fortnite online and like I said I'm still not banned

Edit

Also do not clear logs with dreport if you are on firmware 5.1 since that will most likely get you banned

Is it safe if I run homebrew and use Checkpoint to extract/edit my BOTW save file? I never go online while in CFW.
The only incidence of a homebrew only ban was someone using a GBA emulator and clearing error logs on 5.X. I'd rather chalk the blame to the latter than the former so you may be safe but only Nintendo can say for sure whether or not its safe (and 9.9/10 they would still say its not).

Thought I'd post an update since the last one over a month ago. Still no ban. I'm perpetually online now too, NSPs, online games, devmenu, the new MH, etc. I'm in the UK and have all telemetry options disabled that Nintendo have given us. Running Rei, Hekate, and SX

@Draxzelex can I do it in the stead of a friend of mine who sells modded Switches? I reported a while back on him getting three banned in the process of selling modded systems, and he's gotten more banned since then, but he just had another banned and has it on hand for now so I can go through the whole questionnaire. But as its not mine, I don't know if you want second-hand data.

He's doing SX OS dongle+payloads and then sells them as they get banned/they get banned shortly after being sold.

Any data is fine as long as its formatted using the questionnaire. If proof can be attached (video preferably), that's even better.

I thought I had been pretty careful not to take my switch online.. deleted WiFi login info etc, but somehow my switch has phone home... I know because I have had two emails from Nintendo newsletter about xci copy games I've played.. I have no idea how they got that info. The only time my switch has been near a router was testing SX OS 1.5 FTP functionality with the switch firewalled from the web with a parental filter. All I can think is for a second or two it has connected to the net through some means, and sent a file showing games I have been playing.

Scenario 1 - they have detailed information on what I was playing and I *may* get banned.

I can see two possible outcomes.

Scenario 2 - it's just a record of a game played, but perhaps not the specific info that could result in a ban.

Anyway, my switch is updated to 5.1.0 with 5 burned fuses, and auto RCM turned on, so there's no way at the moment I'm connecting to anything intentionally to check ban status...

Should I be disabling / deleting any accounts or unlinking to prevent more personal info being shared with Nintendo..

Should the device get banned I'm not really bothered, as I don't game online. I would just prefer Nintendo didn't have personal info to tie me to my activities.

Did you play any .XCI files online with a certificate/header? Yes at least while he uses it, he does proper card 1 vs. card 2 injections. But does not know what people do after he sells them if sold unbanned.
Do you have a certificate/header ban (look for error code 2124-4025)? No? He's not aware of any of his carts being banned, just the systems. He's kept reusing certs so probably not but this may be how he's getting tracked down system by system.
Lowest SX Version used when Online/Offline (NOT Switch System Firmware)? Most recent v1.5, but Switches have been banned with probably every iteration of SX OS.
Non-TX Layered FS Used? No. Only SX OS modding and selling.
Did you connect to the Internet with a non-TX LayeredFS Inject? No.
Played online w/ Non-TX Layered FS Injects? No.
Used DevMenu? No.
Installed any .NSP? No on older banned units, yes on the 1.4-1.5 SX OS unit (so SX OS's ripped off version of TinFoil).

Can you login to Nintendo's website using your linked Nintendo Account? No idea, he puts dummy NA accounts on the systems he intends to sell. He has a main, personal clean Switch for his account and personal online uses.
Do you get error code 2137-7403 trying to update your system firmware? Up to date.
Console/Account Region(s) SEA, or at least he lives there no idea what that counts as but the dummy accounts are NA.
Trimmed .XCI? No.
Additional Comments: He's a re-seller of modded systems that he uses until banned or sells them if requested for a modded system. He's gotten at least four banned and isn't saying exactly how many he's gone through lol. I don't think its a small number but he likes to keep his info mostly secretive as its a backstreet business for him with Switch and PS4 mod selling.

Here's some more data, the bans have been spread out ever since SX OS released. They're not immediate and I think his most recent system lasted for several weeks but they seem to come sooner or later.

Since this is second-hand, feel free to disregard.

Nintendo have released 5.1.0 since May 30th. Bans have been happening a day before SX OS and days after SX OS. Last actual ban report I know of was in July 17th. Everyone has been reporting no bans, they keep wifi on while in CFW, a lot of people installing .NSP files, and playing backups online. Major red flags yet Nintendo isn't doing nothing. Better enjoy your online days and unlink that account in the eShop sooner before they ban everyone. Nintendo stated in their site that they will not help transfer content from 1 console to another if you're banned

Can you link Nintendo's statement saying that they wont help transfering contents from banned consoles? Does it mean that they won't unlink your nnid from your banned console?

Another set of updates:
  • Updated the ZIP file in OP that includes an Excel copy of the Spreadsheet. If you want another format to use, just ask me and I'll send you whatever I can.
  • Added 2 confirmed cases of superbans (aka CDN bans). The users are einso and GRAnimated. A word of warning: I didn't ask them to fill out the survey since the only way to get a superban is by excessive CDN downloading with your console's certificate so the responses to most of the questions are negligible but pieced together based off of public posts
  • The poll in the OP seems close what with there only being a two vote difference between the options. I (really) do not wish to return this question for multiple reasons but since not many people have voted yet, I'll continue to keep it open until there is a clear winner

I contacted Nintendo in a live chat a couple days ago about my little brother ban. They just want me to call them so they can discuss about it. This is the email they sent me about a ban console
