German court ruling bans using "coming soon" for release dates in regards to pre-orders

Due to a recent German court case, in which the European retailer MediaMarkt was taken to Munich Regional High Court because of excessive delays on a pre-ordered product, a new law has now been put in place. If a game or product is available to pre-order, it MUST have a specified date of when it will ship and arrive, and it must stick to that. If a delay occurs, then the consumer is allowed a full refund. Listings that say "coming soon" "tbd" or "unspecified" are fine, so long as they don't take money from the consumer.

My PSIO pre-order was placed back in June 2017 and my account charged and money taken straight away. I'm still waiting for it to ship like others are with shipping dates changing every other month on their site updates.

But Amazon NEVER takes your money until the item is dispatched, and you can actually cancel it any time before it is dispatched resulting on no charges being put into your account.
So this law doesn't apply.

Actually vague dates were kind of illegal before. E.g. terms like "shipping normally between x and y dates" or "instant shipping possible" were illegal before. That's why the consumer organisation of North Rhine-Westphalia (Verbraucherzentrale NRW) took action.
And that's absolutely a good thing that it is illegal because if you order and then they may ship from china and you get your item after like 60 days then "instant shipping" isn't worth anything for you. They have to say when you get the item, not when they ship it.

Oh, btw. I haven't seen anything about "if they don't take your money it's fine" in any press text. I don't really think that it makes are difference since I am following not only those consumer organisations but also some law channels and they never said anything about a difference and actually it just doesn't make sense if there were one.

Thats a nice law... no need to pay before delivery anymore. It was quite common in germany to pay preorders... (except amazon of course).

I've never pre-ordered something without a release date before, even if it sometimes gets pushed back. I didn't know pre-ordering without a release date was even a thing. Why?
When I preordered this it had no date:

I only preorder on amazon though as I can then forget about the game until it comes out and they don't charge until it ships.
There isn't really a downside to it (on amazon at least).

So in Germany crossing the border illegally by the millions is ok, but God forbid a game gets delayed.
As a consumer, I would get more annoyed about the latter, that you wrongly described as "a game gets delayed" when it actually is "a company is working with your money without sharing the profits with you, all of this against your will and not complying with the deadlines of a contract".
Both of the cases you presented are undesired, but I don't see why would you downplay the one where the consumer is screwed, that's also bullshit.
