How is it that you know Nintendo can't tell the difference between updating a backup? Especially for people updating backups without original certs headers..
Isn't what you're saying purely speculation based on.. what.. your own knowledge? Which is? Do you have some links, articles, proof?
So the reason people are allowed to update their backups in OFW is because the Switch can download game updates for games displayed on the home menu. This is extremely easy to test. Just try downloading an update for a game that you have physical but without the cartridge inserted. The Switch retains its icon there, for some strange reason. The reason they cannot detect this is because its functionally the same as borrowing a friend's cartridge and playing it on your Switch then keeping it up to date in case your friend lends you the game. They could believe its suspicious you're constantly updating a game that you have little to no play time with online but its a hard call to make.

Also, a headerless backup=a retail cartridge. The only difference is one has the ability to go online while the other does not. All game dumps should not differ otherwise because then that would mean people would be playing a different game. The differences lie somewhere in the certificate hence why it is recommended to never share the certificate with someone else because Nintendo can track this since it is unique to each cartridge.

How do we know that the cartridge cert of the original game (legit) or the backup (empty) isn’t being stored on the Switch and transmitted that it isn’t unique every time you connect to the update servers, hence flagging for a ban. Also, couldn’t they check if you’ve ran games out of your region, etc?

I'll chalk that up under stuff we don't know if Nintendo knows. I never advocated this type of method was safe by any means. I am merely repeating what we do know thus far. Although I think your last point is worth mentioning but to counter that, the console is region-free as well as gives us the ability to select whatever region regardless of where we actually live.

I bought the SX OS yesterday. Here's what I've been doing.

Go into SX OS, select my backup game then I get popped out to the main menu. Instead of playing it, I hit '+' while the game is selected and pick the option to update it. (I guess this is updating software while in CFW?). After the update is done, I don't launch the game, I just go back into the Album, select the next game and repeated these steps until everything is updated. Didn't turn on airplane mode or erase wifi settings. There is NOTHING on Nintendo's network I care about so if I get banned from their eShop or playing online, I COULD CARE LESS.

So here is something I am wondering. We know for a fact each cartridge has a unique identifier. This identifier is cloned and travels with .xci dump. Surely when you load up the game via SX OS and it show up as a tile on your dash the identifier is attached to that game. Even if you arent in SXOS and the game is not loaded that tile that is on your dash has the cloned identifier. When you go to update from Nintendo, surely they can see that you are using a cloned identifier game?

I think the safest way right now is unlink your account then update. Never use your user account that's tied from your nintendo account or has your legit stuffs. Play your back ups and piracy with its own user account that's never tied to a nintendo account.

Just got my SX Pro today and started testing, I want to report back if i get banned, i'm only updating games from the original OS and then right after deleting the connection and rebooting into cfw. Not playing online and havent done any homebrew/layerfs stuff.

If i get banned, will i receive a ban message once it happens or can i only check by accessing the eshop?

I'm receiving my pro tomorrow and from what I'm reading so far it seems OK to update games from the dashboard in ofw without been banned. Do we need to delete any logs or anything beforehand?

Its not 100% safe to update backups in OFW because the Switch can log the usage of the CFW. The only tool we have to clear logs of any kind is nx-dreport and it only clears error logs generated when applications crash and whatnot. https://github.com/Thog/nx-dreport
However, it is not advised to use it on 5.X

To be as safe as possible, you should make a backup of your NAND prior to performing any sort of hacks with Hekate and restore it whenever you go online. There are people being banned with SX OS despite taking the necessary precautions. Although many people have not been banned yet for doing this, that does make it safe. It just means that means they have not been banned yet.

If you play online with a backup, nintendo knows and you will be banned.

If you update with a backup, it is very likely, but not 100% that nintendo knows and you will be banned.

Your best bet is to just not update or go online with backups until we have more info.

I've managed to update games via cdnsp python script and downloading the updates to the pc then installing the nsp via Devmenu, I've updated xci titles by installing the update usually on the SD with the game that runs the xci then removing the nsp file after. You can install updates on the system but SD is easier for me.
I've updated Wolfenstein with the 8gb patch and south sounthpark the same way all seems to be working absolutely fine. Enjoying sounthpark on the switch it seems ok if a little slow loading but I really enjoy the portable aspect.
