Tried this on 4.1.0, still tells me to update eshop :(
Yes because you cannot bypass the step where it validates whether or not you bought the game or not. This is only to keep them installed on your Switch until we have a way of bypassing that step or updating to the latest firmware to confirm you paid for it.

What he's trying to do is download a game that he bought digitally, maybe previously or through the pc, but he's currently not on the latest firmware version. It'd be cool if that worked.

Or maybe you mean that the validation only happens on the latest firmwares?

--------------------- MERGED ---------------------------

How does one clear their Error Logs? I haven't gone online yet.

Validation can only occur on the latest firmware because that is where it lets you connect online. For some reason, despite being banned, Nintendo still lets user verify that their downloaded content is legitimate if they are on the latest firmware but that may be subject to change.

Error logs can be cleared with this: https://github.com/Thog/nx-dreport However, some users have been banned despite clearing their error logs so it is not good enough to prevent a ban entirely

Why are some of you even putting homebrew on your system a year into its lifespan if you are worried about bans?

Look how far 3ds homebrew has come and how "safe" it is to run it and download games and play them yet people still were getting bans. Just assume that there is a chance of being banned the second you alter your switch software in any way.

Hi, I just found how to download games, demos and DLC from eShop after being banned(You can't do microtransactions), you can also purchase this games/DLC :)
The only requirement is to have a Nintendo Account linked to your switch
Is really easy:
  1. Go to Nintendo.com and login with an Nintendo Account linked to your switch
  2. Go to Game Store tab and search any game for Nintendo Switch
  3. Once you are on your game page select "Buy Digital" to purchase the game or download it if it's free, or select "Demo available" to download the demo, if you want to buy a DLC, go to "Add-On Content" and pick "Buy now" to buy the DLC
  4. Once it says to check the state of the download on your switch, go to System Settings(On your Switch), then Users, then the user you used to download your game, and select "Update Download Progress", and get back to Home Menu
  5. Now you just have to wait until the download finishes, and you are ready!
Currently I don't found a way to download deleted games, so make sure that once you don't want a game anymore, you just archive it instead of delete it

Hey!
Maybe this is helpful, if not, just delete my post.

Since I know that it is possible to clear your log with hekate, I used this feature (I think it was since the release of CTCaer mod).

After I received the SX Pro, the first I did was to "install" CTCaer mod as a second payload on it.

So my first start of SX Pro and all I did was just "install" the games and accidentally triggered 2 Updates. So I rebooted into hekate, cleared my log and booted into OFW. Here I started to update all my backups.

After they finished I booted into SX OS and played them. After this I cleared the log and booted into OFW for online play of my purchased games.

This morning I was really scared, because I read all this posts of banned people and that the just installed Updates and did nothing else.

So I jumped out of the bed, picked up my switch and entered the eshop... ... ... no ban jet!

Phew!
So I can't confirm that just updating your backups will ban.

anyone else getting crashes in the settings menu after doing this? i keep getting error code 2181-4008 when i enter system settings
2181 refers to Module 181, which is Dauth (Device Authorization). I don't know if the error code you're getting is different in practice, but SciresM tweeted about getting a Code 0008 from Dauth before, which means his device cert was completely banned from the CDN:

This might be bad news.
Can you still download game updates? Does redownloading from eXhop still work?

How would we fix this? Is there an option through hekate (can't spell) to remove the logs?
"Errors caused by Homebrew (Libnx/Libtransistor/Mucking with LayeredFS) in your Error Log (Yes, even if you have Error Reporting disabled; this is the one that's caught the most people unaware thus far)"

NX-Dreport exists, and it's supposed to clear your console's error history, but nobody is sure if it actually helps with mitigating bans.
Better safe than sorry, nonetheless.

I haven't gone online with my Switch since the banwave started happening. Also I have a NAND backup. Should I wait until someone updates NXDreport or Atmosphere releases, or if I go online, would I be able to fix it by restoring my backup?
I would definitely recommend waiting for a full release of Atmosphere. When your console gets banned, the certificate permanently burned into the board itself gets banned, and there's no way to replace or unban it.

That's definitely not supposed to happen.
Have you used any PC CDN tools like CDNX or HACDN? Attempted to download titles you didn't own through eXhop?
If you're unable to download even game updates (+ Options -> Software Update in the Home screen), you might be the third known case of a fully CDN-banned console.
