Hacking Will X get me banned? If I do Y will Nintendo still detect me? [Information]

Since we got multiple threads where people ask this over and over let's make it clear.
We know nothing how Nintendo will detect homebrew, backup loaders, save editing or any of those things at the moment (2018-06-14)

No, Emunand won't make you safe.
No, deleting past history at the moment won't make you safe.
No, going from CFW to OFW will not make you safe.

At the moment we don't even know if they can detect you booting RCM. They might already have that info.

You hack your console, you take a risk. A risk to get banned.
Else the only sure fire way not to get banned is to pay and play legit. Buy your games, buy your DLCs, don't use cheats.

I think it's really important that people get this through their head.
I dread for the day where Nintendo feels like they have enough information and start a massive banwave.
Like I'll be honest, I'm not confident enough to even enter RCM mode on my legit switch. I caved and bought a second (which I understand isn't a possibility for many) just to even tempt the thought of hacking it.

Be careful guys, if they ban you, that potentially includes eshop access (so bye bye to all your digital purchases)

Its still way to early to speculate for me, only time will tell. The reality is so far noone but people that have been known to send multiple invalid/dodgy requests to the CDN, and people that have hacked in online games(splatoon mainly) have had any problems. Plenty of people are currently running an incomplete version of Hekate/Atmosphere and have had no issues. Will something change in the future? Maybe. The best way to play it safe is wait a while till more news comes out.
If nintendo bans people from using the eshop though, they are effectively taking away something that is going to very likely bring them money. So I don't see them running around banning everyone that uses a CFW right out, especially since at the moment all it offers is retro emulation(if were talking atmosphere), and considering they haven't given anyone a virtual console to use, they aren't losing any money from it as of right now.

To be fair if someone isn't interested in online playing, eventually all the rest will be available to do offline even if banned, i mean we're already nearing the possibility to install eshop games, the same way we will be able to install updates and dlcs. What else do you need?

Thanks for addressing this. Some people seem to think that they 100% in the clear with emu-NAND, etc. Even though we have gotten away with it on past Nintendo consoles doesn't mean that they haven't learned a thing or two over the years. Granted we could be fine and in the clear but we really dont know and should be realistic here. Anytime you are modifying something like this you run the risk of getting banned.

Personally, it's well worth the risk to be able to have a portable emulation machine, even if i get banned. I've got all the games i want, the only games that i'm interested in that has online multiplayer is spla2n... No worries for some of us.

I agree, and also hope you're right about the eShop stuff. Would really be a bummer to miss out on the eShop stuff. I'd like to be able to have the option to buy games that deserve it, even if I'm not, shall we say, following the EULA to the letter when they're not looking ;)

Also they don't have a reason to ban everyone, only people who are pirating games. Booting in Horizon with hekate wouldn't be a reason too. (if simmilar/identical to official booting)

Exactly hence why its not currently recommended to keep a soldered pin connection in the Switch. At the same time, we have to remember that this is Nintendo we're talking about. Even if it security has been clearly beefed up, the only way to tell is by the number of people getting banned.
