Then tell me please how they can ban an unhacked console because he hacked another console by tracing his account to multiple units and banning them all because of what he did on another console ? How do that gives them to right to ban an unhacked console ?
It's unclear how they identified the second console, but irrelevant as long as they did nothing illegal (they could have just identified any console that connected from the same IP address at the same time as any suspicious activity on the hacked console). As for what gives them the right to deny access to their online services, maybe you should check the terms and conditions and user agreements for those online services.

Yup, that is the case.

I love threads about homebrew on ResetEra, I love all the hate agains hackers/modders/pirates that is spread there. Some people over there would probably stab you 20 times in the stomach with a knife given a chance, and would justify it the same way as if they were defending their families. Crazy world we're living in.

I checked and it doesn't state that anywhere, it only states if you break the guidelines and so forth that particular console will get banned. If they ban multiple consoles even unhacked ones wich wasn't the case with this person seeing the last news about this then they are banning you as a person and not the console itself.

As I see it, let them continue to speak hate on us, after-all we don't owe them anything, and never will.. they can continue to waste their time on us if they want, but we should instead worry about indulging ourselves, and if we can then provide works of our own to contribute more to the scene's growth, if not for us/yourself then simply out of spite for those against it ;).

I'm not sure why you don't understand why it's not within Nintendo's remit to do this (you even suggested their actions were 'above the law'). The servers are Nintendo's property and it has the right to allow or deny access. They have a right to protect the integrity of their systems and, if they suspect you of hacking then banning only one of your consoles is a half measure. To imagine that this could cause them any kind of legal problem is absurd.

It clearly states in their EULA if you hack that particular console you can get banned but if you buy a new one and won't do it anymore then you are not breaking any laws or EULA or whatever and they don't have a right to ban your unhacked console. I've read it and it states that they can ban the console you're using and only that specific console. I advise you read it. The EULA clearly states everytime ''The Console'' meaning the console at hand and it doesn't state account or consoles. Note '''the console'' part below ;). Don't see anything that has to do with account banning all systems you own, even unhacked ones.
