As for exFat there is a Free implementation via FUSE on LInux
Even if they use a 3rd party implementation, they need to interface it with the Switch's OS, it'd be far easier to just sideline the official exFAT software update.

it's been confirmed that SX OS will support split files.Well you can just make the update for the SD card... TX will work on any version so why wouldn't you just update the console to last version before using it...
Also TX has updates and they can probably add the other SD formats support anytime they want...
And for last gateway also had a built-in method of running split games with their tool for the 4GB+ games, so TX can also do the same somehow...

We know it, because they strongarmed the closing of a thread I created called "how do we deal with TX selling a pirated OS, here on gbatemp?" - in which they basically did a 180, and swore that they would never sell an OS (with the Nintendo bootlogo on it), but that they only named their product "OS" for marketing purposes (so dumb people would buy it).

3. If its TX OS - they are urging their customers, to update to "most recent firmware" using Nintendos servers, as part of their install instructions, I believe, so - what prevents people from getting the exfat driver at that stage anyhow?

edit: TX calles their Switch OS (which is not an OS) SX OS. Have to remember that.

- have you install DRMed binaries - DRMed by them - so you can get locked into their ecosystem
- bricking your Switch - just to save you a step on launch
