So what happens when you are banned am I right in saying it would mean no online and no Eshop but otherwise no change?
Odd thing is for me I’m not bothered about online and banning people from Eshop will encourage piracy on systems that might only want homebrew.
Is there any other downsides I am missing as it seems if you are not bothered about online then no major issue?

This depends. Lets say there's an exploit that's important to use and it hypothetically requires a web applet, and lets say the ban prevents you from loading any web applets, then you're now going to miss out on using that exploit.

I mean, not playing Smash online is a bit of a bummer imo...

Fair enough thats a good point but with the old switch we always have at least an entry point to boot CFW so is there anything we may need another exploit for other than Softmod rather than a hardmod? Curious as I’m trying to weigh up how major it would be.

My assumption here is that banning us stops the console from connecting to Nintendo servers. so if we had our own servers would we be able to do everything just with a much smaller player base?

My guess would be that games perform a server check before going online, nintendo can't be that stupid

Fair enough so only way would be to spoof that server check which if it is written into each game could be an issue or if it is firmware related then cfw could spoof it?

all this paranoia about getting banned or not it is so stupid.

a) you dont wanna get banned. dont use CFW/Homebrew and so on
b) i never got banned on my 3DS because i played my "not" legal backups only offline and the games i wanted to play online, well i bought them lol

so if you like online play dont mod your console and buy everygame. for me i like online play but i dont mind to get a ban, because if i want really something to play online then i gonna choose my pc over the switch.

that is the risk with modding your switch or doing stuff with it that is not intended by nintendo.

For Example. Nintendo can see your Record of recently played games, but they cant ban you because you could have borrowed a copy from your friend, this would be such a pr disaster....

And i dont think nintendo is so stupid to ban everything because they can get still money from the eshop(DLC content) or the subscription fee for online play, but thats just my opinion.

You lost your purchases (DLCs) and probably game updates too, some games are broken without those updates

Yeah so would mean I would have to use a backup loader to get my Eshop games. And pirate going forward but I wouldn’t really feel any moral dilemma in that situation as Nintendo restricted my access to the Eshop. So for me at least if I get banned then so be it while not ideal I can live without online features. I’m on 4.1 atm and still enjoy my switch. And with gba and gbc emulators I enjoy it even more.
