them settings are a load of shit,

I have had friends list visible since gateway times etc etc etc and still havnt been banned, but i'm not a fucken moron who cheats and hacks online, or plays games before release

Nintendo can see what games you are playing etc without all them settings enabled, it's all in the EULA and such that you agreed to when you started the 3ds for the first time,

every time you access online services with a game, that game registers itself that it's been used online, so the servers knows what game it is, so it can give your game the right information.........
