To use your big microSD and the account you need to update to newest firmware, no way around.
I think the problem is that the Switch uses ExFAT to mount larger microSD. ExFAT was developed by Microsoft and M$ wants licensing fees for every Switch sold. To cut costs Nintendo only activates the ExFAT mounting protocol if the Switch was online, and to go online you need to update. That way Nintendo need to pay licensing fees only if the Switch is used and not for their unsold stock.What if you format it on a second switch with a higher firmware? Will the lower firmware switch still not recognize or be able to use it until you update?

Definitely doesn't look like a refurbished/returned item.
You can just try and ask if they can power on the switch to check the firmware. In any case the most important thing is RCM mode... I mean if the motherboard is still affected by that even a 5.0.x firmware is ok... Better if you try something old but isn't that critical...Sad...now I don’t know what to do, 2 weeks later even more so...to order or not to order a grey switch from amazon (mainland Europe)...was hoping for 4.1...

So I found a guy who was selling new ns but in a damaged packaging. I asked him about the serial number and thx to this topic I knew it should've been 1.0.0. He also told me he never turned it on. Only once (no setup) to see if it was working.
He still has 2 more but haven't asked him about the serial of these.
