Hacking [help] Formating a hacked new 3ds and more, please

Hi, I just got a hacked new 3ds without having previows knowledge about the hacking scene. I'm very excited about trying 3ds/nds games but I have some noob questions and the plethora of info just left me clueless. I'm not sure if it's running emunand or if it's running sysnand.
It's on firm 11.5.0-38U. I would like to format the device because it comes with the previous owner's NNID and I'd prefer to start fresh.
-will it remain hacked or it will become a stock n3ds after formating it? Should I format it with the sd inside or out?
- the seller included a flash cart for ds games, R4 SDHC 2017 Gold Pro Real Time Save, and told me to remain on the current firmware or it won't work anymore. I want to try some online games but theres a prompt asking me to upgrade the firmware; can I update and still use the r4 for nds games? update before or after fromating?
-how to go about updating Luma (it's on 7.1), fbi and freeshop?
-what would you recommend to avoid being banned other than not using leakead games?

It'll most likely be fine to format the console, the old menuhax method of running CFW would have been wiped by a format but that hasn't been used in ages.
Updating shouldn't be a problem, I don't know why he thought the flashcart would stop working as Nintendo haven't been blocking DS flashcarts since 6.x or so.
The 3DS must be on either A9LH or B9S since menuhax doesn't work on 11.5. Assuming he didn't have an emuNAND set up that is.
Best to make sure exactly what CFW you have installed before doing anything to it.

Turn the console off, hold Select and turn it on while still holding. Does a config screen come up? If so, what version Luma does it say? Can't help you until we know what you're running.

I tried it and it shows Luma 3ds v7.1 config screen. Thank you

Trying what Quantumcat said, the emunand option is off so I'd assume that it's not booting to emunand. How would you check what's the installed cfw?

You already checked. 7.1 is fine (it's not the latest, but it's compatible with the latest firmware update)
You should still update it like Hunter said. Also, by following those steps you'll get Luma Updater which you can easily update the CFW with in the future, along with some other useful homebrew. The latest Luma version is incompatible with the B9S version you have, which is why updating B9S is required in this case, but in the future you can just run the updater.

I also recommend FreeShop (the community fork) which lets you download and install games directly on the 3DS from Nintendo's servers, once you add the title key URL in the settings.

I'll do as Hunter and TheRealJdbye said. When I'm going to format the n3ds, should I remove de SD card o it does not matter?

I did all from what you guys said and everything was fine until I started the "finalizing setup" of the guide. Couldn't follow the steps for injecting the hombrew launcher into the download play app because when I restarted the download play app it either opened as normal or it stucked at a black screen. Then realizing fbi was still installed I instaled all the cias from the folder; wich resulted in my home screen having 2 FBIs (1 old version 2 Current version) jeje. The old one appears in red in the fbi "remove cias" option, and the other one in green. Should I just remove the red one?
Also the hombrew launcher installed just shows a black screen that says "hombrew" in both screens and cant do anything more. I think that I'll need the hombrew launcher eventually and it would be nice to have it working. How can I make it work?
And stacked dump (whatever that means, it seems really bad). I've saved the log but it is on a format not suported by gbatemp. Should I be concerned about this? How would you fix this?
After all this I saw on a youtube tutorial that to launch the hombrew launcher by injecting it I had to turn on "allow patching" and something from arm11 in the luma menu. Is that so?
I'm really sorry, I know this is a bunch questions and troubleshooting, I just don't know hoy to proceed and would love to have a full functioning hacked 3ds.

Do you have boot.3dsx freshly downloaded from the guide?

Now I do. I had not read that part of the guide and now it works great.
Also, now I have only one fbi installed. That was fixed by restoring the health and safety where it was injected.
It hasn't crashed again (stacked dump) and it's now working flawlessly.
