I have used Pokemon UM online no problem (unmodded) and did not (yet) get banned.
I'll turn off wifi whenever i use CFW stuff now, tho, just to be a tad more secure.

Is it a pirated version though? Because almost everyone that got banned had it pirated at one point or another.

I had pirated USUM but didn't get around to playing it or updating it to 1.2 yet and I am not banned. However I switched to a public seed just to be safe.
Checksums for the currently unbanned public seed I am using (and just one hint: iso ).

Does using freeshop have anything to do with getting banned? I hacked my 3DS’s (one Japanese, one NA) a long time ago back in the early days of a9lh and both are still unbanned. I’ve downloaded a lot of games using CIAngel, used a bunch of homebrew CIAs, used FBI injected into hs, and both consoles are still fine.

I dont think this ban has anything to do with pirated games or unreleased games but the fact that unreleased games usally come from anoughter region.When you play region free or out of region games its just as bad as running homebrew since they count as unsupported software on your 3ds.When you leave the wifi switch on your 3ds it automaticlly connects to your nnid on your friends list which is connected to nintendos server.From that server alone while connected with your nnid i think they are able to record the software that you launch on the homemenu.In theory the rosalina menu can hide the applications you run with the wifi on by tricking the 3ds into thinking its running a normal application,but you are still running unsupported software while connected and we dont know how deep the recording goes.

Yet there has only been a single report of someone being banned who does not have USUM and updated it to 1.2, even people who have played 1.1 based romhacks of USUM haven't been banned.

If you get banned on emunand, you're also banned on sysnand if they share the same localfriendcodeseed. You can use as many public localfriendcodeseed as you want, you're just gonna get banned regardless

I think that actually works in my points favor since not having A leaked copy of usum means he was banned from homebrew like fbi which could of got recorded awhile ago with the wifi switch on or a out of region/region free game that isnt supported on the 3ds since the usum leak isnt the only out of region game that exsists.If your not banned yet from these 2 things we can narrow down you will either eventually get banned later or that they already swaped seeds with a public one to avoid getting there private seed banned.

No, the point is I have only heard of one person who did not have USUM 1.2 getting banned, despite several people who were not banned despite playing a pirated and romhacked copy of USUM 1.1. So if it has nothing to do with the USUM 1.2 update why are only users with USUM 1.2 getting banned for the most part and people without USUM 1.2 aren't, even people who play USUM 1.1 romhacks aren't getting banned.
And no, the leak seems to have nothing to do with it either as even people who didn't get it until a week after the release got banned (assuming they updated to 1.2).

Actually, it is pretty easy to do so. How many people who have played USUM and updated to 1.2 have been banned? How many people who either don't have USUM or haven't updated it to 1.2 (perhaps because they haven't played it in a while or because they are using a romhack which is 1.1 based)? That is pretty strong evidence right there.
Not really... many who haven't played a rom hack got banned. Some I know even got banned without even playing usum

Well then why don't you help by providing some data to rule that out rather than just saying "we can't rule anything out" and shitting on other people's attempts to try to get to the bottom of it?

Im not shure how they can read cfw through the server.But i cant say thats wrong either since we have no way of determining the ban trigger.
