BOSS telemetry still collects everything Nintendo needs to know to ban a user.

Can I get a source on that? I was under the impression that turning off sharing data with Nintendo was turning off BOSS telemetry. If that isn't the case, I'd love to be corrected.

If I remember correctly, @RustInPeace was one of the users who reported being banned despite having SpotPass disabled; perhaps he might have more insight on the matter.

Oof, PlatinumLucario's speculations are absolutely worthless. He didn't dump any wireshark data, and he seems to conflate game spotpass with the "share system information with nintendo" settings.

Kinda glad I never updated to either A9LH or BS9 if this stuff is happening. I can't say much though, as I'm lucky I still can do anything. I'm still using the ancient Menuhax ways, as I didn't have wifi at home. Public wifi (usually my local library) was really my only answer, so I never bothered updating. Also, my speakers are blown (though not my camera's speakers), so I haven't really touched my 3DS in a long while. I only take it out very rarely to brush up on my Smash skills (*starts singing* "One is the loneliest number...").

A9LH and B9S are almost certainly not the culprits. If you've installed unofficial cias, and/or pirated games, those are what would give you away.

Oh hey. That's old news and my banning circumstances are different to the point where I don't report on my status anymore. But since I'm mentioned, I'll just get into that.

Today the only console I use got banned, even though my general 3DS usage has decreased significantly over the last month. All I do basically is turn on the console, go to the Homebrew Channel through the Rosalina feature, boot up NTR CFW, go into a Pokemon game, and do requests using PKMN-NTR. PKMN-NTR requires NTR CFW and I have an NFC patch that makes it connect all the time instead of having to at certain points. Because of that, I'm able to edit many aspects of the game in real-time, which is handy for genning requests, which is all I do these days.

I get banned seemingly every other month and they've always been temporary, 28 or 30 days. I was last banned on December, unbanned on January, about a month of freedom, and today that ended. Having multiple consoles that now I never use, I can and have unbanned myself. Also whenever I call Nintendo, they always said my ban's permanent, the 002-0102 everyone else gets. My spotpass has always been disabled, so there's that. I used to think running CIAs, specifically NTR was the issue, but it's still happening running the 3dsx version. I just think it has everything to do with my live editing. Nobody seemingly does the level of requests/edits I do so I can't compare my situation to anyone else. The bottom line is they have always been temporary.

I'm o b9s ...and back then on the last mass banwave was on the A9LH . But I never put hacked cias. Only emulators , injects VC and games on freeshop and ciaangel...Never get banned.
I never linked a nnid on my console , never turn on the spotpass or use friendlist . All turn off.
But always have the wifi set on.

I have never been banned, I got my 3ds around 2015 and I modded in early 2016, I always have spottpass disable, and recently got my friend list on, I erase the majority of the homebrew cias and use rosalina to enter to the homebrew launcher, I normally use ftp to transfers files as well jk save manager in .3dsx, I have b9st since July last year I think, I normally don't play multiplayer games and only use for pokemon shuffle check in, besides I'm been playing in coop nsmb2, I normally left the wireless off, I think they collect some data in a determined time, after that they blacklist the 3ds and start the banning process after month have Passed, it might explain why people previously banned got banned again even though they have privated seeds

I've personally always had my Spotpass on. Between two systems over the last 3 years, neither have been banned... Even shared the LFCS_B with a couple people, encouraging them to spread it to others that can be trusted online but were banned

I've had Spotpass on ever since I got a clean 3DS back in August. I don't think that that is the reason. I'm not going to go into a rant about what I think the flag is, because I do not know, and none of you know either. All I can do is tell you what I've been doing to avoid a ban so far:
  • B9S 11.6
  • I only use homebrew via Rosalina.
  • No Freeshop, even via Rosalina.
  • No leaked cia installs, ever.
  • If I want to pirate, I use FBI remote install and the titlekeys site.
  • No VC injects, nothing not vanilla that is logged in the activity log.
  • Never cheat in online games like Badge Arcade and Pokemon (Battlespot).
What I do use, and haven't been banned yet:
  • FTP file transfers.
  • Appear online, and favorite game.
  • Spotpass.
  • Online gaming on pirated (but released) games.
  • Patches like Umbra Moon.
  • Transferred hacked, but legal Pokemon in gen 7.
I'm sure I got lucky, just my 2c.

I'm going to say again that the only thing we know is that these banwaves took place around the release of two major Nintendo IPs (Pokémon Sun/Moon and FE Echoes, the later coincidently was also when B9S was released IIRC). There are people with Spotpass enabled who weren't banned, there are people with it disabled who were apparently banned, some people who haven't cheated or gone online with pirated games and homebrew weren't banned, and we know a ton of people were banned for going online in the dump of the review copy of Pokémon Sun/Moon.

We know the cause of some of the other bans like the public header Sky 3DS bans and other flashcart related bans, and the rumored ban from trying to access the eShop page of unofficial software which happened when somebody Spotpassed a fake Twilight Princess 3D title.

Speculation is fine, but don't try to pass your theory off as fact because spread misinformation sticks around here and you're doing more damage than you are being helpful.
