One of my consoles got banned, and that one is in normal 10.3.0-X. I have various physical games, also I have 46 titles in my Download List in that console and a lot of them aren"t free titles or updates.
Soooo,the thing that decides to ban you or no kinda screwed up an is banning everyone with a large number of titles,this is practically the confirm

200? That's crazy, I've only just hit 60 and I've had my 3DS since launch. Admittedly my collection building has slowed considerably of late.
Did he purchase his 3DS secondhand? Perhaps a previous owner had hacked it.

I have been a long time lurker but decided to throw in my 2 cents hoping that it will help everyone figure out how the ban works.
I have a N3DSXL (launch) on 11.2.0-35U, A9LH, Luma (forgot version- tell me where to find it and I'll share) and an O3DSXL (TLOZ: ALBW) on 10.7.0-32U that hasn't been touched. I don't cheat or have pirated 3ds games but I do have a bunch of roms a few cias and some pirated Smash DLC. I have never used Freeshop iirc. I have used a Powersaves to modify a friend's Pokemon OR game and checked the save on the N3DSXL. I have used my N2 Elite (with unreleased Amiibo "tags") with the N3DSXL and my Switch. I still havent been banned on any console AFAIK. I only get Error Code: 002-0119 when I check my friend list.

But did anyone with no CFW used Homebrew Launcher on Sysnand and get a ban? Because I only have the Homebrew Launcher via FreakyHax and I don't want to get banned, at least I'm not banned for now.
I haven't heard of any cases, but it's possible I missed one or two.
There's no obvious pattern, so I wouldn't bother looking too deeply in to it. People have been banned that haven't used their 3DS for months, some on the latest firmware, some still on 11.2. Echos is also not worth basing anything off either.

It afects my RF4 undub? this game have no spotpass and Neverlan died years ago... i don't want to lose all my data and my relationship with Margaret T.T

So at some point a9lh added steps to putting a9lh into a hidden partition of the nand for recovery purposes. If I remember correctly this was not in the earlier guides. Any chance people that are banned have that file there and those that arent dont have it there?
I dont think that proves anything, we need to see if everyone that did get banned had that file in there. Because if I were nintendo and lets say I got a list of 10,000 users with detected CFW I would ban randomly half the people to insert uncertainty, then a week or a month later ban the other half making them think it was something else.
Also does a9lh and B9S block native firm writing? Thats something that an update can try to do then check if write happened (CRC) if not then flag the console?
I have FE:Echoes but, legit from eShop. However, I have CFW installed so, I wonder if those are the two conditions being looked for.
Also native firm blocking. Each software update can alter it's CRC by simply changing the string that stores time/date. It can attempt to write native firm and then check the CRC. If write failed flag the console. Both a9lh and B9S block native firm writing.
If i were Nintendo I would also check the CRC of the Health and Safety app to see if matches the original or if it had an injection. As well as activity log against a "whitelist" anything that isnt on the whitelist of all official released software flags the console. I wouldnt ban for just one of these offenses, but would do it only if at least 2 different things hit. So for instance Health and Safety fails CRC and there is FBI or FreeShop in the log (you dont even have to check for those, just check if there is ANY software that isnt on the whitelist). Once two of several checks flag my confidence goes up that I am right about the console being hacked. As a software engineer this is how I would approach it. And there are at least 5 or 6 different things I can check (just off top of my head).

- Can check boot routine
- Can check presence of a9lh/b9s file in NAND (one for recovery)
- Can update native_firm and check it
- Can check activity log against a whitelist (actual log not necessarily the app).
- Can check for Heath and Safety inject
- Can check for out of region games that would be impossible to play without a CFW (MH: XX, Fire Emblem (before release))
- Can check for CPU speed (since Luma allows overclock, fun fact, some 360 hacks/mod were detected by DVD Rom speed and voltage pull)
One of my console in 10.3.0-X without CFW and all legit titles was banned, but it"s psossible an isolated case and very weird:
I am banned. I think i got banned like 5 mins after I updated to b9strap but I don't really play online much so I'm not bothered
