Yes, mine was turned off and I got banned. I read that it turns back on when updating firmware, so at least since 11.4's birth it's been off.
I disabled spotpass as soon i got my brand new 2DS before even installing a9lh or any other non-official app.
Call me paranoid but i usually disable any type of telemetry or "sharing personal information with the company to enhance user experience" in any device

my 2DS had it on (now turned off) and was not banned (yet?)
my n3dsxl had it on (now off not that it matters) and it was banned, not that it matters tho since it had already been banned on sumo banwave (was unbanned after clean lfcs b injection)
both systems are EUR on 11.4 running b9s + luma
n3dsxl was just recently updated to 11.4 (like 4 days ago) and went online with it at that time (after b9s install)
2DS has been on 11.4 for a while but haven't connected it online in about 2/3 weeks (haven't connected after b9s install)

Nope, not banned yet. I can play Mario Kart 7 online just fine (tested it right now).
Now since you thought it was disabled... how many of the "it's disabled and I'm banned" are actually true?

I didn't know they made an MSU cart for the Genesis.... I knew about the SNES one and the library for that is rather large but the Genesis one has very few games+1
