Na - seems write locked - not fake to me.
Is there a lock slider on the sdcard?

Have you ran chkdsk on it?

Don't worry about the hs.app it only really matters if you want to make your own injectable .app(s) or restore h&s app.

The other way to install fbi is through h&s as mentioned above, but you'll need to be able to write to your sdcard again

I'm currently reviewing what i'm missing... so far it's working... if even after that I'm still not able to move on from this step then i'd see again coming back here...

I have a lock slider but I don't know what chkdsk is...

If you are attemping to install FBI for the first time, you should proceed even in this way:
1) download the last version of FBI.3dsx from there: https://github.com/Steveice10/FBI/releases
2) Copy-paste this file into the folder called "3ds"
3) boot your 3ds, launch the homebrew Launcher, run fasthax and then run FBI
4) install the FBI.cia that you should already have into your sd

I don't have the fasthax option on my Homebrew, only the fbi, however when I click on the fbi it says " FBI has encountered a fatal error! Kernel backdoor not installed. Please run a kernel exploit and try again": What should I do here? >_<

That's because you're not using fasthax I believe. You don't have fasthax option (I think), because at one point in the guide you delete the 3DS folder and then replace it with another - meaning your 3DS folder does not have fasthax in it on your SD card. You need to add those files again.

Now it said "failed to install CIA File"... am I missing something? I did copy the fbi.3dsx into the 3ds... why is it not working... :/

I see.

I think that could be because i'm missing one step... the Health & Safety one. I can't seem to download the hs.app..

The Health & safety step shouldn't be related with the alternative way that I suggested you
On the guide it says:
Section VI - Finalizing setup
  1. Open Health and Safety (which is now FBI)
Maybe it does? :/

--------------------- MERGED ---------------------------

I'm worried that there's no way out... I've tried literally everything

You should open the health and safety app only if you injected FBI in it, otherwhise it's just useless. I was guiding you to install FBI directly from the homebrew launcher without the need of inject it into the Hs.app

Do you perhaps know what these files called "h2w" are Do I need them?
You can delete them, they was created by H2testw to check if your sd was corrupted. Maybe you can't install a cia just because your sd is full. Delete them and retry to install fbi through the homebrew launcher.

Ok.... this might be my last problem but I can't open the CTR NAND after downloading all those cias... it says "modifying the NAND is dangerous and can render the system inoperable. Proceed? I proceeded but it says "Failed to open file listing archive"

Actually there's not a reason to open CTR Nand except copying there the arm9loaderhax.bin file from the Luma's archive. So, this isn't a real problem.
