Wouldn't be hard. Seattle is a 25 minute drive from NOA's headquarters in Redmond lol.
All they have to do is get a single rep or lawyer to say "Boo!" to smea and he'll submit. He's not going to even chance a fight with a giant international company over some homebrew project. (and especially with a lucrative Silicon Valley career at stake)

But seriously, all that talk about C&D, is it even possible for Nintendo to sue Smea for something which is unreleased? It's like arresting a terrorist accusing he'd have plans of an attack which hasn't happened yet, feels like Minority Report
If you bought the 3DS, you have the right to modify it. Installing homebrew applications is perfectly legal, but exploits found can lead to illegal stuff like piracy. Smea and colleagues has found an exploit to install homebrew apps but do not condone emulation and piracy. Much like Microsoft on windows (in which the OS can run emulators but do not directly endorse it)
Ninjhax came out awhile ago, why would Nintendo finally be doing something about it now? Also is anything Smea doing really illegal? He's just writing programs for the 3DS. I think we void our warranties if Nintendo finds out we've been messing around with unauthorized software but it's not illegal.
Like I said, he modified the 3DS because he bought his own product. The illegal part is where they make emulators for it.
Emulators aren't illegal. Downloading ROMs is illegal.
Side note: Just because you own/owned a game physically doesn't mean you can download ROMs legally(At least in the US, most European countries, and Canada). The only legal way to acquire ROMs is to dump them yourself and even that it is legally questionable.
I totally forgot about legit rom dumps. but yeah, most of the time people use emulators for piracy.
Nintendo took down a site the had the coolest roms. If they take down that one site that has all the isos for the 3ds, then there would be no issues right?
