Hacking Playing legit bought eshop games through SD card on hacked 3DS?

I just purchased another 3ds with 4.5 firmware and I'm using the latest firmware of gateway. On my previous non hacked 3ds I've purchased some 3ds games from the eshop including pokemon x/y and smash bros. Is there a way I can transfer those games and play it on my hacked 3ds using the internal SD card while still keeping the save files and the ability to play online and use street pass? I also plan to transfer these games again to the new 3ds when it comes out to the states.

I think you can do a system transfer to a fully updated emuNAND. However, a 3DS update came out recently and emuNAND is currently not working, so you'll need to a wait for a Gateway update that supports emunand 9.0 first.

Yes, you can do a system transfer but that requires you to be on the latest version. Emunand doesn't work with 9.0 atm.

I did a system transfer to emuNAND. Everything works fine, but now that it's on a "hacked firmware" it feels like I could lose the games at any time. Not saying this will happen, but you can't be sure.

Personally I would wait until you get the new 3DS and do a system transfer there. Unless you plan on selling it right now.
I want to play on my hacked 3ds in the meantime and transfer it to the new 3ds later. I plan to sell my old non hacked 3ds once I get everything to work. I just don't want to be playing back and forth between my hacked and non hacked 3ds.

You should be able to transfer them back, but I think that would require the latest firmware (at the time of purchase of the new 3DS), to be functional with Emunand. No guarantees for that. I'm not sure about the save files. Also, I don't think this is your intention, but feels prudent to note anyway: afaik you wouldn't be able to duplicate the eshop games. In other words, you can't transfer from Emunand to the new 3DS, then restore the Emunand with the eshop games.

In any case, for now all you can do is wait and see if/when Gateway get Emunand working with the latest firmware. Then you can decide if you want to go ahead, bearing in mind that a major security patch in an upcoming firmware release, could make it a one-way transfer.
