Any CFW is a risk. We dont know how they distinguish differences between CFW and OFW.

No. Cfw alone isn't a risk. Nintendo can't even tell it's running. The only way to tell if it's running is via an interrupt. If atmosphere isn't present, system crashes.
I've never seen anybody ever been banned for simply using cfw.
Nintendo's server looks at unusual error code and flag your Switch for investigation, and if there is foul with Switch, they banned your console permanently with total loss of access to eShop.
Atmosphere has anti-ban protection in place to send error codes to SD card instead of register into NAND, but sometime, their protection glitched that allow error code to be registered into NAND. Unless you have NAND backup, unusual error code register into NAND, you are screwed up. The ban doesn't occur overnight but happen anytime.

Some people advised to avoid tesla overlay and use Edizon to enable the cheats, but it is inconvenient.
There is other method that Nintendo rely is telemetry, but Atmosphere blocked most of telemetry servers by default if not all, but Nintendo can add new lines without users' acknowledge. That affect users who use Atmosphere online.
As for me, I use Atmosphere offline since first use in 2018.
