This depends, if they do the same with they did with the NES emulation, then yes its possible, I do not go online and i do not have a subscription. But i play the NES games.
There is compiled NSP complete with Games AND OR additional games not on the current service.

Also in relation to banning, its not just pirated games, I bought my switch, used CFW only for emulation.
It was this that got me banned (I suppose Emulation is a form of Pirate, but Retro Arch crashed, must of sent a log to the server and about a week later i was unable to access the online services)
In which timeframe did you use CFW? In the beginning there where bugs that caused some logs to be created, but Atmosphere added many protection for log creation and sending.
So did you realy not do anything else? Like install a homebrew nsp, cleared logs, cheated, used romhacking accidentally online, used SXOS without creport and whent online with ofw afterwards, experimented with things like the dev menu, or something similar small but flagging?
I'm using CFW on both my switches for years now, and even multiple family and friends switches are 100% of the time in CFW, none of them is banned yet.

I'm using CFW on both my switches for years now, and even multiple family and friends switches are 100% of the time in CFW, none of them is banned yet.

This was very early on in the homebrew / cfw scene.
As you have said things have moved on a lot and measures have been taken to prevent logs etc from being submitted.
I was never really fussed to be honest, anything the online services offers i can get (Other than cloud gaming)
Multiplayer on the switch has never really interested me in the games that are offering.

No i only did CFW to emulate, Zelda fan and i needed to scratch the itch with OOT and Majors Mask after finishing BOTW, All my games i had where legit (Apart from Emulation)

They do care because It is easier for you to pirate games with cfw, and if they detect you have installed cfw, you get automatically banned.
Bunch of non-sense. You don't have any information about that so please don't spread misinformation about stuff you don't know anything about. This guy got banned because he installed nsps and xcis of games he didn't owned. That's one of the ways Nintendo detects if you hacked your console or not.


And for the N64 games app that will release, I don't why you wouldn't be able to get them if you install the nsp when it'll release, just like you can with the SNES and NES apps at the moment.

if you have custom nsp's installed that will also ban you.

Well, then I'm still screwd. Also, are there any news about transfering save files from banned to unmodded switch?

It's possible, but risky to do. Especially with games that have cloud saves.
You can use JKSV to dump the saves. Then you need to access the unmodded Switch by dumping it's NAND, inject the saves in that dumped Nand and then restore the modifed Nand.

No you don't. You just need a "unpatched" Switch to do it stealthly.

my switch got banned for using CFW and pirated games. Is there a way or some method to unban it?
Piracy is not worth it. If that’s why you got the switch sorry it’s gonna definitely result in a ban every time. Best selling it in to a pawn shop and buying a new one and starting a new Nintendo account over a vpn with a different name and address etc. if you got to play pirate games never play it online. Have a virtual partition / nans that boots from sd card and another sd card for your online stuff and keep em separate. I’ve had my switch 4 years and used it online and never played a swingle pirate game on it.

What gets me is that there are ways to evade pc gaming bans by spoofing stuff so I don’t see why someone can’t develop spoofing for the switch to evade bans, heck you can even do it on android to evade bans I’ve done that by spoofing my serial and identifying info and also on iPhone. Guess people are too scared if Nintendo to do it

There are lots measures you can take to evade bans (and all good guides cover those), that's why people running custom firmware can do lots of stuff online, like downloading stuff from hb-appstore for example. There are even means to play online (obviously away from Nintendo official servers).

Usually people gets banned not on their custom firmware, but on their legit firmware by using custom firmware features. The legit firmware lacks the protections the custom firmware have.

and thus Nintendo bans their switch... Pro's and con's of pirating. Where as hacking a switch with cfw won't get you banned outright. They don't care because you paid for the hardware. They care that people steal money from devs, just pay for games it's really not a big deal....
Why would I do that when I can get it for free?
