I removed CFW from my New 3DS XL, and am wondering if I risk getting banned with spotpass on even without CFW.

You basically still have the same chance with or without cfw and with or without having spotpass on. Why did you remove of cfw anyways?

I wanted to renew my 3DS to stock conditions, I know it sounds stupid.

--------------------- MERGED ---------------------------

3DS systems aren't prone to bans like the Switch. You really have to do something bad to get banned on the 3DS.

So I am fine to use online an spotpass? I thought I heard about Nintendo banning a lot of 3DS's a while back.

that was years ago on account for people going online with leaked games early.

That would be FBI. If you are this paranoid with the cfw, Why did you install cfw in the first place?

I installed it for all the things it gives you, but after an almost brick and some data losses, and learning about potentially getting banned I decided it was not worth it to risk ruining my new 3ds that I just bought. I did CFW my old 2ds but the touchscreen broke :( and I'm not going through opening that up and trying to fix it again lol, but if it wasn't broken I would just make the 2ds have CFW.

Also, it bricked because I followed a most likely outdated video tutorial. I have learned not to use those. The data loss was because my SD card randomly corrupted a few times randomly. Good thing I made lots of backups:).

EDIT:
Also, not that I am going to do it, but just for future references, would I full system reset remove those tickets because I am not sure if their are any up-to-date ways to do homebrew without CFW. I remember when soundhax was a thing and also I did steelhax a long time ago but those were a long time ago and most definitely not supported anymore.

You also realize that those 3 things you mentioned. Can also happen without cfw on a system aswell yes?

I think people mostly got banned using a 3ds flash cart, I think it had something to do with headers. If you use the home menu, than you should be good because the home menu has its own header for the system.

Headers were game based, i dont think home menu had a thing to do with them. I know flash carts are liable to get bans if people have no clue how to use them.

Steelhax still works perfectly fine, although Picchax is preferable since it is more reliable and has a smaller download.

However, neither of them are good for anything except JKSM and Anemone; other .3dsx programs might run, but only if you're willing to mess around with .xml files and "targets". FBI is right out.

Godmode9 can also be run without installing CFW if you have an ntrboot cart.

Could gm9 be used to remove the tickets or is that a no go

Yeah bad game headers, playing pirated games early, and accessing Nintendo's CDN server were the easiest and most common ways people got banned. And flashcarts. So basically piracy in general. They have less tolerance for that.

What is a CDN server?

There really is no point in removing CFW from your system unless you want to resell it. Everything you've described in this thread can also happen on a system without CFW and the risk is exactly the same, if not higher. If you're afraid of bricks after you've installed CFW, simply don't do anything risky, like installing CIAs from sketchy sites or playing around with GodMode9 or FBI. It also makes sense to keep a NAND backup.
