I’ve literally had my Switch connected to the internet without a DNS or whatever every day while using exclusively atmosphere for over a year and a half and haven’t been banned lol.
Nintendo haven't been actively banning people in about that long but that says nothing about how many people have been flagged for a ban. We will know once they decide to start doing ban waves again.

Soooo, they’ve never been actively banning people :thonk:, a little over a year and a half ago is when FG released.
And I somehow doubt that I’ve been “flagged” for over a year and a half.

Your guess is as good as mine as to why Nintendo haven't been actively banning people, but the fact is, I haven't seen anyone complaining about getting banned here for a long time. And most of the complaints I heard were on SX OS. I don't believe it's because they have no way to detect CFW or NSPs. They have had a while to come up with new detection methods and yet people haven't been getting banned. It seems likely to me that they have been flagging people, rather than the alternative explanation which is that they've just been twiddling their thumbs and not even making an attempt.
My guess was that they were waiting for the right moment to strike, and I thought the release of Sword/Shield would be the perfect time, especially considering the leak, but nothing happened.
