It's been 2 years I had this problem and I wanted to know if there's any way to fix that.
I know the 3DS is thinking the headphones are plugged in because when I take a photo the shutter sound plays on the console's speakers (this sound plays even if headphones are inserted) and I can confirm with 3DSident :

I tried to take apart the 3DS and see if I can do something and I figured that my problem can be this :
Below is a schematic of a regular headphones jack mechanism and I think the contacts on the left image are not made in my unit.

The 3DS headphones jack looks like that (picture from iFixit) :

And even with looking at the pins voltages I didn't managed to know wich pin is what.

I have CFW installed so I can install pretty much anything. I hope a software fix is doable, I don't really want to mess with small electronics.
I don't really care if I can't use the headphones jack normally after the fix, I just want a way to switch between internal speakers and headphones.

First guess is as you say and somewhere in there is a hardware is detected mechanism, usually a couple of strips of metal which either make contact or break contact to indicate what goes. I don't know what system the n3ds uses offhand here and if it can be tricked with software.
If you can get a hook in there then you can try bending it back but if you want to be able to regularly swap in the future then you ought to consider a replacement socket of some form, or tap the speaker outputs for a bluetooth adapter or something, as something that is already deformed is likely to head back there before too long.

Similarly incidents of headphone jack stuck as (ghost) inserted.
If the toothpick, wooden skewers, or other nonmetal probe inserts doesn't work, it might be stuck due to open circuit from one or more dead resistors.

Other than using a good pair of wired headphones,...
Hand grip + velcro (or disk magnets) + bluetooth transmitter mods

Thanks for answering but I've got this problem BEFORE modding my 3DS and it was not during a system update or anything. I put my 3ds on my desk, went outside a couple of hours and when I went back home they were not working

One of those threads talk about continuity testing resistors near the headphone jack with a multimeter. The reddit link has someone fixing theirs by probing the jack.

Worst case scenario would be to desolder the jack and solder in a replacement. Unfortunately, the hard part is sourcing a replacement 3.5mm auxiliary port. The ones sold at digikey.com and mouser.com might not be compatible with the n3DSXL.

Did you finally find a solution to this problem? I am in the exact same situation as you.

Nope, I just found a cheap Bluetooth adapter to connect to an external speaker,
I'm pretty sure I would need to replace the headphones jack itself to make it work again
Solved, software solution for Luma3DS 12.0
I can't says link, for google search: "[request] Option to force audio routing to onboard speakers #1837"
