You need the ROM patcher and a WEP or unsecured Internet connection. A phone hotspot works too. Hotel/airport/restaurant/etc. WiFi won't work, because those usually make you agree to their ToS or whatever.

Not really any way, unless you go to a friend's house and play it or something. But, WPA(2) support is planned for DS games. There's no work done for it yet, though.
