Hacking BAN Reports on 2nd hand games played on non-modded Switch

Hey Guys,

I've been part of a brazilian NINTENDO SWITCH TRADE group on facebook for quite some time now and we have seen some interesting reports recently, check the img on the link (idk why I can't link direct images here):

I could translate the whole thing here, but I feel like just explaining it so please bear with me...

Nintendo actually banned a user account that bought a 2nd hand copy of Mario Kart 8. The previous owner of the game was using the cart unique cert to play the game online via backup, Nintendo might've discovered it and probably banned both user accounts (the guy who bought the game got his account banned for sure and the previous owner we don't know anything about him yet, if he got superbanned, console banned or account banned).

The facebook post OP said his Nintendo Switch wasn't modded in any ways and that he lost all stuff he has paid for on his account (luckily only a Nintendo online Service subscription). He can still play online and access e-shop/buy games/play online and stuff, but he won't risk going online with that mario kart cart online anymore... For obvious reasons

I've never seen anything like this around GBATemp so I found this could be quite useful. @Draxzelex maybe this could help a little bit on your ban research/pool.

I've never ever encountered a verified account ban. Is he unable to login to Nintendo's website using the account linked to this console? I wish he also posted some error codes.

I think he got the account banned wich Nintendo doesn't allow selling accounts. If you sell an account and Nintendo finds out about it they ban the whole account wich is illegal by itself but Nintendo doesn't care

You must buy the online service for each nintendo account on your console to be able to go online (unless you are into a family plan). One of his accounts got banned, he's still able to log into another account, buty the NOS and play online.

He's unable to do what you said. He did not post error codes or anything else but I have already asked for that.

Ah so it wasn't a console cert ban. That Mario kart game is no good might aswell toss it in the trash unless he plans to hack another switch for its use.

I think I've heard about this before, if Nintendo ban a game, then they will ban any account or switch that use that game.

Does Brasil have Nintendo online services? I knew that some times ago Nintendo left the Country due to high taxes

You can still buy second hand games if the source is reliable

I read a similar thread on another facebook group .... But i'am sure that's fake because nintendo community in brazil wants nintendo back ... so some Youtubers are telling their subscribers to don't use any mod on nintendo switch to nintendo back to brazil


About the facebook groups , a lot of game stores owners are creating this fake posts to encourage people buy new games on the stores and don't buy used games.

They also say that nintendo can ban your console and brick the cartdrige game tracking the cartidrige that was used on a modded switch .

Tldr;

people are creating a lot of "fake news" to sell new games and encourage nintendo back to brazil.

I think most of us probably already knew that would eventually happen... It was already said by quite a few ppl for some time already in this forum that nintendo could totally ban the game cartridges and that it could lead to bans of consoles\accounts in the future.

Now that guy was a bastard to sell a game while he "stole" the game certificate, he ripped off someone and even caused some damages to that person. All he can do is contact Nintendo and explain the case, but it won't probably lead anywhere ;).

EDIT: In my opinion if Nintendo doesn't fix that problem, they are doing that illegally as they should check the entire console to see if its modded or not, if they have 0 suspicions they should totally have fixed it and just ban that particular game from going online, but not ban anyone else unless they detect something modded on the console.

As far as I know its not illegal to sell used games, at least here, so the person that did something illegal is the seller for ripping off the buyer and Nintendo for punishing the buyer (in case they don't fix it).

I don't think Nintendo will do anything as this is the perfect way to squash the second hand market, which they all have been trying to do for years. Unless there is a big enough backlash on social media, it's probably gonna take some sort of court ruling to fix this.

No, this isn't a "perfect way" to do anything except for piss off an entire consumer base.

That's a miss translation from OP, he says he CAN'T go online.
Doesn't seem like a conspiracy from gameshops to sell sealed games.
Let's wait and see if the guy provides any error code.

OP replied saying he can't link the banned account to the console anymore. He is also unable to access his account trough internet or eshop or whatever the way.

He created a new account and subscribed again to NOS.

That's not miss translation. I made it very clear his nintendo account was banned, not his console. So we assume it is still possible to go online with the console.

Did the OP contacted Nintendo about that? Sounds to me like the some sort of anti-cheat measure where Nintento bans the cartrige and account (for obvious reasons)
