Some users have reported that even if their consoles never got connected to the net after modding it, they started getting a message notifying them about a new update available for their games (XCI or Nsp) while they didn't get them before. The culprit could be some newer games that were added to the library, it seems that those games somehow added the "Update available" for all games. This being said, Nintendo could use future games (that will be downloaded as backups) to detect a hacked consoles and get them ready for an instant ban once connected to the net. Or even worse Nintendo might even run a code that will block NSP or XCI reading.

I predict a lot of people saying they have been updating their .XCI games in OFW safely while not citing any evidence that .NSP games have banned numerous users.
I was updating all of my .nsp games and no ban till this date. Can it be because of me disabling all telemetry (cause in Europe)?

Nintendo will continue to try and c***block us at every step of the way, whether it's code contained in both system or game updates that will detect any abnormalities in the system which will most likely end with you getting banned, or they might just kill any CFW that tries making it easier for us. Shutting us out again and again every time there's added "Stability".

aren't the people downloading from Nintendo's servers at risk of being banned? I mean the download service that can be done on the pc. who's going to risk that for other people's sake?

They were using a "burner" console cert to download games onto their PCs, so unless they used their own console cert - they won't be banned for downloading things. They've got a much higher chance of being banned for just installing the NSP Online however.

If Ninty isn't checking if the game is connected to your account, which I don't know if they do...

It seems they use a combination of "did this account on console X buy this?" and "has this console downloaded this file before (through someone else's account)?" to gauge whether you're "allowed" to install that game.

More recently, they've been burning certs within the hour instead of the cert lasting at least 3 days to a week which is mostly why public certs are pretty scarce, and many have been told to just use their own certs instead (according to the Warez Discord at least) so they're definitely getting better at weeding out legit and illegitimate requests using whatever info they can get their hands on.

I still use 2 week old cert tho... :D

aren't there checks if request is being sent from a switch and not a pc or is that what the cert is doing (spoofing a switch)?

It's essentially web requests. I think at one point the requests it was performing looking nothing like switch requests, hopefully they've changed that.

Except the current CDNSP cert has been valid and still IS valid, for at least a week, possibly more than that

so are you downloading the app that downloads from Nintendo with the cert already applied or must the cert be found elsewhere? and, I take it that there's no way to dump an account's games instead of risking a cert to download directly?

It's bigger than this, to download games you get through ads and ads means money, at the end no one does anyone a favor, it's all for money.

I'm getting afraid that this is the new route they will take to force you on updates; that the game you download has extra data to activate "forced" updates for all the games that could potentially have one (if they're outdated, or have been updated in other than the intended ways)
Kinda similar of what some software does to shared tools that are outdated: you install a new software that shares certain files with others, and now every one of those will prompt you to update because of it (Looking at you, Adobe. That's a really dick move)

If this is the way they're going, i wonder; what would be the best way to address this? There's the possibility of keeping the games that are downloaded the most stealth possible by 'scrubbing' them out, without any certs or something traceable, but that would require a ton of work; something tells me that it wouldn't be foolproof either, since Nintendo seems to be doing their homework this time.
There's gonna be a need for experimentation in the no-so-far future.
