Hey there,
I bought a used Switch and after recently reading about banishment, I decided to know if the previous owner was messing with the console and I was left with a beautiful offline device.
Here are the latter emails between me and Dan, the Nintendo support operator that seems quite a nice guy. I even asked a couple more questions:
So, if in doubt, just ask Nintendo!
They require your email, nickname, date of bith (for some weird reason), and console serial number. I'm relieved by this, I'll just enjoy some legit games, demos and play some cheap indies, because Switch games are quite expensive, specially first party.
I know everyone knows this. Just wanted to post it here so everyone knows it's possible to know beforehand what you are getting.

Thank you for the details.
I confirm you that the console with serial number XAJ70034XXXXXX is not banned.
I inform you you cannot download a game while the console is turned off, as the internet connection is needed, however, if it is turned on and in the dock station, the download works fine.
Well, I don't really have a favourite game, but I enjoy playing Splatoon 2 more than the other games.
Should you have any other question, feel free to ask.
Kind regards,
Dan

Also, does the console download games while in the docking station or with the screen turned off?
And what is your favorite game on the Switch?
Thank you for your help.
