I'd imagine you can get it via Freeshop, providing you've got CFW. As for legit methods I think you're outta luck

I managed to get it on the DSi Shop years back during the very tiny window of time it was available. I think it was only available again for a tiny amount of time on the eShop but I never managed to catch it.

Yes. It a black screen and told Error has occurred

as far as i remember, dsi ware can be fickle at times and some games on freeshop just don't work right for some reason.
also, did you get the right region one?
there's a cia somewhere out there on that iso site. might be burried in the vc area though

I looked for the cia everywhere and not a single place has it. So i doubt that the freeshop version works specially since it's not on the actual eshop.
