You won't get banned if you have it enabled. So far I haven't been banned with my main N3DS the last couple ban waves. My O3DS was ban because of spotpass was on. If you inject a public local friend code seed, expect to get banned all the time.

Yep, it does really make sense. However, @The Real Jdbye is saying it as a fact. Just want to know the techy details behind it all.I want to say that it would make sense for Nintendo to have the log of software used, regardless of privacy settings.

It was private and all I do is play rpgs and i don't cheatWas this a public seed ban or a private seed (the seed that came with your console) ban? If this is your first ban then it's a private ban which could be connected to a new wave or you did something to piss off Nintendo individually.

So avoid using .cia homebrew when you are online if you are worried. If you need to use FBI network transfer, or FreeShop, use the .3dsx of them versions loaded through Rosalina set to a legit title.
