I was thinking maybe that or whoever banked on Nintendos exploit program knew of a way for Nintendo to detect modded systems
I highly doubt it, there have been people without Fire Emblem who have been banned. Picking up on modded consoles wouldn't be difficult either, as all you would need to do is check the Activity Log data that they've most likely been collecting, and the use of FBI or Luma Updater will make it obvious enough.
