Homebrew WARNING: Nintendo is banning CFW users randomly, for no reason

"For no reason" lol. As someone who has been banned, its kinda hard to not understand the reason, hell its right there in your title description. We're CFW users, which is obviously not OK with Nintendo. Though frankly I'm shocked it took this long for such a banwave to occur.

On what does the ban affect?
Can there only be a ban if you are using a NNID on your CFW'ed console?
Can there only be a ban if you got CFW and play a game online (with / without NNID)?
Can you be banned for being in home menu and connected to the internet while on CFW without playing any game (offline nor online)?
If banned, what is banned, NNID or only the console if you have no NNID connected?

It's not illegal, it's just against the TOS.
Sorry, but that's just not true. In most countries, USA included, DMCA dictates you are not allowed to bypass encryption. This makes pretty much everything being done with the systems illegal. Did you install sighax? Did it bypass encryption? Illegal. Are you downloading encrypted games and decrypting them without paying a license fee? Illegal.

The real question is if anybody with a homebrew only system (no cfw, not even the old menuhax+emunand setup) has been affected.
I used just the HBL by browserhaxx about 3 years ago, haven't done anything haxor related since then. Not banned right now, if it helps somehow

They also ruled that jailbreaking/rooting is legal. CFW isn't that different from jailbreaking/rooting.

Maybe, but people have had all sorts of different setups reporting getting banned, even those without homebrew CIAs. Right now the scene is trying to figure out what exactly it is that Nintendo is tracking that indicates CFWs.

If this is true, which has a high chance, that means that playing installed cia's like Pokemon Moon wouldn't get one banned, right? So as long as you disable wireless connections on the 3ds while launching FBI etc. you should be safe, right? Just an assumption

Guess me asking for unistalling B9S was a great time. I wonder if any OFW people been affected.

You're under the (likely incorrect) presumption that they haven't been logging whatever it is they're looking at to ban users for weeks, months, or even years. I don't think for a split second that reverting cfw is a good way to prevent this ban wave....

I still have to wonder why people though 3ds cfw was totally safe, there is pretty much zero attempts to spoof/hide any hacks, anyone with Wi-Fi connected pretty much broadcasts directly to Nintendo what homebrew your using
