TL;DR.
But it looks like some people are using Copyright Math.
Edit: Alternative Facts work as well. Since they seem to be trying to make the world fit their world view regardless of what the actual facts are.

Maybe you should ask mods to lock it. That way people can't post without reading. Not reading 8 pages. What I saw of the last page was boring and convoluted justification that sounded like something the industry spouts everyday.

Why need to lock it? There's no reason to close off discussion to those willing to actually read the main post. I put a lot of effort into that post, it's not my fault if people choose to only read the title and reply.
I am also leaving it open because I am open to suggestions, I am open to grammatical fixes, classifications, etc. Coupled with the fact that I made this thread to detect the "is this homebrew legal?" conversation from the main thread and or from another thread being made to ask the same question.
Plus I gave two TL: DR options, right from the start and right at the end

I mean hey, if for some reason ya don't trust crystal and still think it's illegal after reading the op then just don't use freeshop. It's not like she's forcing you to use it.

Then what about CiAngel? It basically allows anyone to install and play games for free... I guess that's because FreeShop is more known than CiAngel...

At the core of things, its still the same thing. Installing games on Home Menu and playing them For Free... The goal is basically the same eventhough the methods arent...

Yea I was using the argument that some had that piracy with FreeShop was illegal even though there are other methods of piracy.

the only defense that comes to mind to me for freeshop is that you must provide the ticket and that you should normally just get the ticket for the game from the game itself since you should own it in the legal case of this and so after having the ticket you can just use freeshop as a bit of a better alternative to the eshop having numerical download numbers and sizes and quicker menus, although I assume along with many others assume that most just hook it up to a title key database and just use it for piracy, it somewhat falls in the same grey are where torrents fall, it's not specifically for piracy but is primarily used for it

Yea I doubt most of people who use FreeShop will bother owning the physical game when you can literally get it for free. And you don't need to have it to play it. The case you're talking about is when a game is so obscure that no one bought it physically to get the ticket and update FreeShop so others could get that game right?

Great thread for the noobs that have plagued the forum with these pretty dumb questions. No offence to those genuinely worried about stuff.

Hmm I been lurking this topic a while.

I think I can do a nice TLDR for everyone,
Is freeShop legal? Yes
Is using freeShop illegal? No
Is downloading something with freeShop that you don't already purchase illegal? Yes

I should add hyper links because I put all that at the bottom

CIAngel itself is debatable. Where freeShop requires you to find your own keys, CIAngel actually downloads them directly for you. So it's a bit more debatable. But without illegal keys, the same laws apply to CIAngel as freeShop

If the game is on the eShop, then it's perfectly fine to download them.
Your only ever at risk with leaked games, which would never hit the eShop early and thus wouldn't be part of freeShop

For a change of pace, where does the legality stand on downloading foreign versions of a game you already own domestically? For example, I have the NA versions of BB:CSII, Code of Princess, Samurai Warriors Chronicles, and Sonic Generations sitting right here on my shelf. If I were to download the Japanese versions of these titles, where would the legality stand on it then?

Before someone jumps in and says, "Of course it is. You already "own" the game.", I should point out that the titlekeys for the NA versions are different to the Japanese versions. And, I feel like this is creeping in a similar territory to, "I bought X game for Y system, therefore I should be able to "legally" download the version for Z system as well."
