ROM Hack System Transfer from Banned Homebrew O3DS to New 2DS

If I did a system transfer would my unmodded 2DS be banned? Is it safe? Would I even receive the software? Hell, COULD my SD card even receive the software even though it's not formatted? Any information is welcome. Please. I need my Pokemon Moon fix.

Also I do use the Freeshop, I just wanted to see if it was possible to get moon from my O3DS to 2DS without having to purchase a new copy. If it's not possible then I'll just buy a cartridge and inject my old save file into it. Thanks.

Just hack your 2ds using the softmod guide, then transfer all of your save data using JKSM.
