If it's coming directly from Nintendo it'll most likely be on latest firm

While yes, it is most likely the case that a refurbished one will come with the latest firmware, someone recently was sold a refurbished console directly from Nintendo that was on 9.6.0.

The chances are so slim of it not being on the latest firmware that you may want to take a look at other options (eBay, for example).
I can almost certainly say that you wouldn't get one with hacks already on it. I'd have to imagine they clean the system and SD card, if not replace it entirely.

For what it's worth I bought a refurbished 2DS from Nintendo a week ago and it came with 11.0. I emailed them to ask if it would have the latest firmware and they said it all depends on when the unit was actually refurbished what firmware was loaded onto it. Again, for what it's worth.

just got my reberbished its 11.0.0-33u AKA i can hack it then downgrade Im so happy

I think N3DS has 11.0 - 11.2, but O3DS has <10.7

My brand new 2DS from Target had 11.1. I think it depends on where you live though. On Reddit people were getting brand new 2DSes and O3DSes with 11.0+. These days I use eBay to buy lower firmware consoles, though they're mostly expensive but sometimes you find steals.
