Some claim it transfers the ban, some claim that the source system keeps the ban.

I don't personally understand how it'd transfer the ban, since isn't everything used to track the ban in a read only area on the 3DS, with the exception of LocalFriendCodeSeed_B for the 0102 ban?

Who here has experience, and can you provide a detailed description of what happened?

I can't find any solid consensus, and would like to hear from more people before trying myself (my 3DS comes tomorrow).

Thanks

You can transfer from a banned console, but you need to remove from the console first.

In my case, going from N3DS XL to N3DS XL, it transferred the 022-2812 NNID ban with it. My previous console is no longer banned, but the new one is. Other people have had the ban not transfer at all, and their old console remained banned and the new console remained fine. I don't know why different people are having different results.

Either way, you'll have one banned console and one unbanned console. Probably.

look this method from @Giodude HERE (You have to do this one to unban the Source 3DS FIRST!)

and now watch this thread from @Wojton HERE (This has been confirmed that it will NOT transfer the ban IF you do the following steps from the previous thread I did mention up there.)

I did try, I have my N3DS intact and my O3DS got unbanned... of course before the transfer.

Would this still work if I unlinked my NNID from my banned 3ds by using that method where you downloaded an arm9loaderhax.bin file that spoofed your device to have a different device ID, and unlinked your NNID by pressing X+Y in System Settings? (http://gbatemp.net/threads/pokemon-3ds-ban-what-you-need-to-do.449472/ first method in that link.)

This doesn't require the modified arm9loaderhax.bin though and yes, it will work by unlinking your NNID with X + Y (Beforehand, if you modified the SecureA_Info.bin)

The problem is (with arm9loaderhax.bin) ... it is very risky because you are using the same ID as others would use.
Do you have a second 3DS?

Well no, (I have a stock n3ds, but that doesn't really count) but I stopped using that arm9loaderhax.bin file after people said it was unsafe to use, so shouldn't the ID not be the same now, since it was the patch that was spoofing the Device ID?

Oh, exactly.
That is just a spoof. Yes, unlink the ID and edit the SecureA_Info.bin and done. (You will be unbanned yourself except the 002-0102 tho)

The setting I mention was if you WERE to transfer or do another ID with that spoof.

Will I be able to relink my old nnid?
Unfortunately, no. (IF you have another Device ID injected.)

When you try to re-link again the NNID you just unlinked, the 3DS will say that "The NNID is already on another console"
Because the NNID has not been remotely moved or formatted yet on the original banned Device ID. (Formatting involves erasing our e-shop history and we don't want that.)

Even if you try to inject the nnidsave.bin of your NNID on ANOTHER DeviceID, it will say that "The NNID cannot be usable on this console"

Wait so I can just format my old 3ds and I should be able to link my nnid to my new one.

Based on what I know, only formatting the NNID will NOT be sufficient to be able to link the NNID to another console. Nin may only remove or a system transfer the NNID.

Worth to mention:
Ninty of USA, are very strict with this rules. They will ask for everything and if you don't give a good answer, they will ignore you. Those sons of a bitch.
Maybe, there's hope... if you email a Spanish Ninty, only via email, they will unlink the NNID to pass it on to another 3DS casually without question. Only say that you lost the console and you will be out! I don't know for the ban though but still a try) HERE

I talked to Ninty USA yesterday and got an NNID moved today (this was not from a banned console, but from a DsiWare transfer and I didn't wanna have to wait the 7 days).

It was simple enough, I told them I dropped my N3DS in the pool and needed it swapped back to my previous one. All they needed was both serial numbers and some purchase history to verify my NNID account.

Alternitavely you can try this route (https://www.reddit.com/r/3dshacks/comments/44fdqu/guide_transferring_nnid_to_a_new_system_without/), I didn't see this till I had already called Ninty.

Now that you mention that, I could've said that...
Even if I "lost" it, even if I gave a fake date, they still didn't approve my request!

My native language is Spanish, and I do understand perfectly and write English but talk it... that's more like the accent of an insecure person trying to think something at the moment.
The Spanish guys always move me into an English Department. and I hate that. "Ellos te lo van a resolver" "They are going to resolve it"
lol ... always the lady who knows everything fake I mentioned.

You can transfer from a banned console, but you need to remove from the console first.

In my case, going from N3DS XL to N3DS XL, it transferred the 022-2801 NNID ban with it. My previous console is no longer banned, but the new one is. Other people have had the ban not transfer at all, and their old console remained banned and the new console remained fine. I don't know why different people are having different results.

Either way, you'll have one banned console and one unbanned console. Probably.
The reason yours seemed to have transferred the ban is because 022-2801 is specifically an account ban (not exactly positive though but 022-2803 is the closest thing and is specifically an account ban, 2801 might be slightly different) whereas 022-2812 is specifically a device ban. You can transfer a NNID but not really anything that'd track 2812
