Yes. It has been since the 23. for Europeans, and the 18. for Americans. The bans were for going online early with the games.
How many days has passed from your eshop ban? 10? 15 or more?
I have this issue in my 3ds.. cant go online at eshop, but thanks to FCS_B i can go online to play at least.

So the 022 ban may also not be permanent?
some guys in my country said they could connect to the Internet now,but they still could not access the Eshop

I'm pretty sure then can and will check this file. That's how they banned you in the first place so they clearly can see this file. I bet they are just waiting till a ton of people are using it then will mass ban them all. Just like public headers.
So if I had the early cia installed, but never turned on the wifi since then, how would I go around getting online without risk?

If you want to be on the safe side, do it. Although the bans were because of getting online early, and not exactly because of the version. Since the leak is a cartridge turned into .cia, it's still best to use the freeshop one, though.
