Hello ! Sorry the title is maybe a bit long, but i wanted to be clear. So I have a question. Can I be ban if, on my french 3ds I go to the Festival Plaza with the "eshop" (Freeshop) version of the game ? Because the game isn't out yet on the French eshop and maybe that could be a problem. Please i need to know, I want to do some trade with some friends ! Thanks for your answers :) !

Yes you can. The chance to be banned is low, but there will be.
Remember, this is a permanent ban. So, if you can't wait for a few days and want to risk your entire console then... do it at your own risk.

So if i wont go online on a EU 3DS there is no risk of getting banned ? I will be getting the game of freeshop.

Is the ban permanent?
I'll be totally honest here, we simply don't know and there have been many conflicting reports. The current consensus is the 002-0102 error is a 15 day ban, as this error has occurred in the past (most notably, users of early sky3DS carts received this from using public headers). That being said, there is no guarantee that these cases are the same.

The 022-2812 hyperban on the other hand, is a ban that we have very little information on. Previous to this incident only a few systems had ever received this error and it was a lifetime ban. Reports from those who contacted nintendo also infer that this ban is permanent. All that being said, we don't have concrete proof so the best suggestion at this time is to wait out the 15 days to be sure.

First of all Australia has the game already they are in the PAL region same as Europe so in theory you should be fine PAL carts exist thanks to Australia
That's very plausible. They could easily check your country and then bam... another one got banned.

Yet again PAL carts exist people will import them to play the game early you won't get banned for playing online if you are in Europe hell I had X early a day early if that counts I haven't been banned.

But they can see if you have a cart or a eshop version of the game no ? This is why Nintendo could ban people in the first place

Yeah, nice logic. You wasn't banned before, so you won't be banned now ? The same logic was used by people saying it was safe to play Sun & Moon online early. See where it got them.
Again, there is always a chance that you'll be banned here. You don't know how Nintendo works. And this ban is permanent. Therefore, if you want to risk your console, then do it. Just remember to prepare for a sudden ban somewhere down the line.

C'est totalement faux si l'on préfère les cartouches, les fuites ont poussé Nintendo à remplacer la date du 23 par aujourd'hui.

That's totally false if you take a cartridge, the leaks led Nintendo to make an anticipated release today, even in France. The stands are out in any shop and supermarket.

Eh, can I play online NOW with the freeshop version? My 3DS region is US.
I shouldn't get in any trouble now, right?
