In my opinion, user land homebrew is okay.

I don't really like the "5 games of your choice!" Gimmick because that's pìräçy, same with bundling title grabbers like free shop. There isn't a difference.

A9lh is ok as long as no pìräçy related tools are preloaded.

I am looking at this through a legal spectrum.

No one's gonna come after you if you're not buying and reselling cuz "free games" selling one is fine.

It's morally okay as well if you don't charge a lot more just because a9lh is on there.

I would maybe pay, at most, 10 dollars extra for a9lh.

I've sold a fair share of A9LH enabled 3DSes - including a New 3DS XL, and right now I have some softmodded 3DSes ready to go to new buyers. I charge reasonable prices - a n3DS XL costs $260 with taxes here, and the brand new Sandisk 64 gb card goes for about $25. I charge $300 each to Canadian buyers and I teach them how to use them.

I usually install FBI, JK's Save Manager, LumaUpdater and the HB Loader. Anything else, they can download on their own.

My feelings are:

I sell modded consoles for the same price as vanilla consoles, with the exception of if extensive hardware modifications or repairs were done on the console that were of significant time and or cost to me.

I don't see anything wrong and charging a bit extra to install a9lh and downgrade and stuff. There are some people that genuinely have a reason to be afraid of bricking because they have had bad experiences, or just don't want to do it themselves. Honestly, I wouldn't charge more than $20 more than the consoles worth just because of a9lh (still cheaper than the cost of an entrypoint for 10.7), but I guess it depends on the person.

a9lh is no different than other services. Some people pay others to mow lawns, even though they can "easily" do it themselves.
That said, a9lh only increases the value around $20.
It's also dumb how people charge for including more games with a modded console, though if it's free, it saves time of the user's end.

Yeah. It makes sense if it comes at no extra cost to the user, because it saves time installing the games. But if you're selling games you freeShopped, that makes no sense.
Legal games are kinda a gray area, because you just get to say "I legally have the game" and have proof for it on your eShop or NNID account.
On the other hand... you could just freeShop/CIA/ticket+eShop it.

By proxy, yes I would be paying for the A9LH install. But I won't pay a random seller more for A9LH.

If I were to sell a N3DSXL with a9lh, I'd sell the N3DS for $180, with $40 for a9lh since it takes a few hours to a few days depending on schedule, and setting up everything afterwards takes a lot of effort. I wouldn't charge for games as they could just download it off any cia downloader or something, but I would charge $10-$30 depending on what SD card they desire.

You would pay a guy to mow your lawn, because that's a lot cheaper than buying your own lawn mower plus you don't want to spend five hours doing it yourself and do a crap job when you could pay a guy for three hours for a good job (he has experience and knows what he's doing) and not have to buy a mower. Same thing here really. If people have a lot of time and/or they don't feel their time is very valuable then it would make sense for them to do it themselves. But if not, they have the choice to pay to get it done. People should be allowed a choice.

This. If you are skilled enough you'll look for a non-modded console to do it yourself, that's if you can find one that wasn't updated before. I value my time and even refused jobs because I needed time to study.

Nobody lives off nothing.

I sold one recently with no added apps or games. The buyer asked me if I would add emulators and Freeshop so I did afterwards. Not worrying about it much.

I think the entire area is grey and is totally dependent on the individual.

In the case of 3DS homebrew I personally feel that labour should be paid for in some way but code and utilities should be shared in the spirit they were originally released..generally speaking.

I'm reminded of when I dug out my old Saturn collection (probably my all time favourite and largest bundle of gaming stuff I own) a couple of years ago and decided that I was going to mod the shit out of my machines and get them all maxed out in terms of features and options. In addition to installing the regular region / speed switches one machine ended up having a modchip in it and I used that to flash a memory cart with the freely shared homebrew Pseudosaturn "modchip on a cartridge" solution.

For some reason, noticing afterwards that firms that were selling re-branded Action Replay carts and official memory carts obviously reflashed with free homebrew software for huge mark ups just sat wrong. After all it's not too tricky to disc-swap your way to flashing your own Pseudosaturn cartridge without any other modding and official carts are very cheap to buy (especially from Japanese sellers on ebay).

Lower the mark up, be honest about the origins of the modded hardware you're selling. Or not. It's your call. No judgement can be objective when the area as a whole has shades of grey and open to a spectrum of exploitation.
