Hardware Wanting to sell 2DS with a9lh, is it legal?

I want to sell my full Hacked 64gb 2DS with cfw + a9lh so I can buy and replace it for a N3ds.

Is it okay to list it on EBay? Also I think my Network ID is still attached, how to i remove my network Id?

It should be fine as long as you're not selling it with pirated games on the console.
Format via the System Settings to remove your NNID.

Technically it's not allowed - hardware or software that circumvents copy-protection measures-, but even when items are flagged it takes Ebay a fair while to get moving on things. They don't know what most stuff is. A quick sale would be a good idea.

Concerning removal of NNID, a format will not be enough. You need to delete it in settings. Beware, though, once it's gone, it's gone forever and all games associated with it are gone too, on the 2/3DS and on the Wii U if it is linked with that. If you want to enable it on another device you have to perform a system transfer.

Oh no...! Will that remove a9lh?? And will that mean I need to buy a N3ds to transfer my Nnid before I sell it??

Just formatting it should be fine? Deleting your NNID is a bit overboard.

When it comes down to the law of selling hacked products, it's a bit of a legal grey zone. Technically, it's not illegal to hack your system nor to sell it with those hacks. It's really when you encourage piracy or sell it with pirated software pre-installed on it. It's basically the same grey zone that Flashcarts fall into.
I suggest avoiding terms like "Hacked," and "Modded," ect. And just mention in the description that it "Includes A9LH pre-installed." Also don't charge extra for the installed A9LH, that's when shit really starts getting deep. But looking it up, I found this

I don't know whether a transfer of a9lh will work - a9lh would surely be broken, I think, because it relies upon a console specific otp? That's just my guessing though. You need someone with more knowledge than me, so I'll step out.

Concerning the NNID, yes, you will need to peform a transfer before selling. Deleting is definitely a final procedure in that it does void the account altogether.

Hmm, now I'm not too sure. I thought Nintendo servers had a record of the console on which an NNID is stored and it has to be transferred? Maybe not though, as I'm fairly sure I've had different NNIDs on emunands in the past. Out again before I confuse you and me both.

However, if you want to keep the games, you have to perform a transfer. Nintendo could do that via phonecall after a sale, but that's a bit risky and you'd lose all your saves unless you back them up and restore them manually with JKSM or savedatafiler. System transfer is the only way to preserve what you have. But, you need to wait for confirmation that transfer of an a9lh console will work.

Hardware and software are treated differently when it comes to that AFAIK.
You own the hardware, you can do whatever you want with it.
However, you don't own the software (ie. games), only a license to use it.
That's a very important distinction, however I think the laws on hardware modding vary a lot between countries.

eBay doesn't technically allow it, I think, but a lot of people have been getting away with it. It depends on whether some asshole sees it and decides to report it or not. PayPal itself definitely don't allow it, but unless you're a big flashcart/mod seller I don't think you have much to worry about, at most your auction will be deleted.
You might be better off using whatever Australia's equivalent of craigslist/gumtree is. Those kind of sites are more lenient and you might get a better offer there anyways.

Yes, again I'm not sure and it hasn't been tested in the courts in the UK so probably very grey indeed. "hardware or software that circumvents copy-protection measures" comes direct from Ebay's reporting tool, but it's debatable whether that covers this. Nintendo wouldn't like it, but Ebay don't seem to care. Definitely loads of people selling modded consoles openly. Ebay reporting seems largely ineffective.

a9lh doesn't circumvent copy protection, cfws with signature patching do... actually, the existance of legit cias argues against this statement, proving that piracy doesn't require signature patching, and in fact it helps the user use legal 3rd party software, which is very good for the consumer!
