Depends on the n3ds you want to buy. Some newer special editions have the newest firmware. Some n3ds consoles could have been in the store for months, so they have to be on older firmware.
not at this point, consoles are manufactured months in advance to release so no brand new consoles will have a firmware past 10.3 for now.

the same thing applies, they are manufactured months in advance to announcement/release so there is no chance that any of them will be past 10.3 (or 10.4) for a while.
What if he is on 7.2 and an 3ds ROM needs 9.2 firmware? Can i update to just 9.2?

if it doesn't, well you'll just downgrade it to 9.2 in the guide (format it at least once before downgrading to prevent a soft brick!)
