Simple question, but couldn't find the answer.

Can I play a (region patched) US-region CIA game on my EUR N3DS (Emunand 10.7 with Cake CFW) without having a ban risk? Offline and/or online? And can I visit the shop without risk of having such a ban.

This is true? I thought a lot of out of region people might have been playing something like monster hunter x online with a .cia version with no ban.

I'm gonna go right ahead and say there's no proof for being banned for playing other region games online. Me and my friends have done this a lot, repeatedly and we've never even had a temporary ban or anything of the like. Go right ahead!

Exactly this even the people who were banned using MHX online at the time were people using an incomplete translation which had online stuff patched next update, that and they were reported by the users friend in the thread not directly on site.

99% of all bans on gbatemp have been gateway/sky3ds users and 1% has been people cheating or other online.

Out of that 1% like 2 people have been OOR cias (which were not reported by them on site but friends on here)

I'm playing bravely second online and it isn't released in my region. I haven't had any problems.

When you say "playing online" can you clarify a bit? Are you doing the moon rebuilding and update online data to get villagers, etc? I also have the region free originally EUR Bravely Second on my USA N3DS but am a bit apprehensive to play it (especially any online features) because of worries about bans!

Yes, I updated data online for more moon villagers. It wasn't a problem.

Never encountered any issues updating my castle in FE:if, and while it's been released in North America, IIRC you can't access Japanese castles using a North American copy and vice versa.
I installed a European Pokemon X CIA on my sister's 2DS and she's never had any issues with online battles and trading either.
