Long story short: it uses browserhax and some related hacks to inject pokemons on your save file using your mobile phone. Everything is fine until you realize that there is a price tag attached on it. 4 bucks.

I am not a lawyer and i don't know if there is something wrong on using a open-source licensed software or non-commercial use software in this way. Of course i suspect that some violation is going on but that's not the point here (even counting that we are moving in a shadowy area of the law anyway)

The problem here is surely ethic: someone is using the work of the 3ds scene in a commercial way and doesn't make anything to point out the fact clearly. The entire injecting procedure is based on the *hax here. Is there something i am missing? Don't want to sound rude but this seems so far from the homebrew community spirit i am a little sad.

I am developing an homebrew pokemon save file editor right now. I know that this may seem conflict of interests but of course it is not. I am not even considering that this is a pokemon related app. Mine is an hobby done a couple of hours before going to sleep and this seems a commercial work done with some investments and an effective group of developers and designers.

Scumbags will always try and make money off off free software.
Scalpers make money off off buying launch consoles and selling them for double/triple the price, exploitable games etc.
Hell, even bushing wrote an article about it on hackmii.

It's disgusting but it's not illegal.

This is basically what Gateway team is doing everyday. (Emunand 9.6+ support, OOT3DHax usage, Ninjhax usage).
Anyway i'm quite sure using a GPL licensed sourcecode in a commercial project is not allowed cause GPL for example says that you have to release sourcecode of your executable. (and i doubt the app creator will release sourcecode) [ http://www.gnu.org/licenses/gpl-faq.html#GPLCommercially ].

I saw people selling hacked pokemons.
1euro each one 5euros legendary+shiny ones, here in spain...
And claiming to be legit ones

It is probably a violation of a software license, therefore illegal in most of the civilized countries of the world. Although i think that the legality/illegality makes no difference here anyway, this is plain unethic in my opinion.

Remember that those scumbags won't care about it.
They make quick money and stop before authorities come snooping.
Most of the times, authorities don't do anything about it.

Take a look at the amount of people pirating music, television shows, games etc.
People pirated Terabytes of data, some even sell Terabytes of data and never get caught.
Another problem with piracy is the media.
Media brings attention to torrent trackers and what not so naturally, people are going to take a look at it, see what it is.
Then they start pirating them selves.

It indeed is unethical but you can't really stop it.

Edit:
This is relevant to it.
People selling Xbone games, pirated... Xbone games.
Similar to the PS4 hack.

I don't mean to endorse piracy but if you really feel like you should have these things for free, pick up localIAPstore if you're jailbroken and that should do the job. ;)

I guess it's a bit of a dick move to not give credit to some work from others that you use, but that's about it.

If it's not worth the money, people won't pay for it. And if you want to convince others it's not worth the money, release a pirated version or make a free alternative. I prefer not to involved legalities.
